FIRE RESTRICTIONS

8.30.030 Provisions supplemental.
8.30.010 Purpose.
This chapter regulates outdoor fires which are found to be potentially dangerous to the health and welfare of the public. (Ord. 2024-016 § 1 (Exh. A); Ord. 559 § 1, 1989)
8.30.020 Outdoor fires.
A. It is unlawful for any person to cause or allow any outdoor fire within the city limits of Sequim except as authorized in this section.
B. The following fires are allowed:
1. Cooking fires contained in barbecue pits, grills, smokers, hibachis, or similar devices, or facilities specifically designed, built, or manufactured for outdoor cooking;
2. Recreational fires for pleasure, religious, ceremonial, cooking, warmth, or similar purposes where the total fuel area is three feet or less in diameter and two feet or less in height, and must be fueled by clean, dry cordwood or charcoal, and are at least 25 feet from any structure or combustible material;
3. Portable outdoor fireplaces when used per the manufacturer’s instructions, and are at least 15 feet from a structure or combustible material unless they are being used at a one- or two-family dwelling;
4. Portable propane fire pits when used per the manufacturer’s instructions;
5. Residential fires to burn small amounts of yard waste accumulated on residential lots only where the total fuel area is three feet or less in diameter and two feet or less in height, and must contain only dry, natural vegetation, and are at least 25 feet from any structure or combustible material;
6. Fire from flares, torches, waste gas burners, incense burners, insect pots, or similar devices when used per the manufacturer’s instructions and monitored as intended;
7. Bonfires for ceremonial purposes, and must be fueled by clean, dry cordwood, and are at least 50 feet from any structure or combustible material;
8. A controlled fire authorized for Fire District 3 or the Department of Natural Resources.
C. The activities described in subsections (B)(7) and (B)(8) of this section must obtain authorization from the fire code official, and a permit or exemption from the Olympic Region Clean Air Agency (ORCAA); a copy must be provided to the city police department and Fire District 3 at least five business days before any burning.
D. No trash, milled lumber, or construction debris is allowed to be burned at any time.
E. All outdoor fires must be constantly attended until the fire is extinguished. Fire extinguishing equipment must be available for immediate utilization. (Ord. 2024-016 § 1 (Exh. A); Ord. 559 § 1, 1989)
8.30.030 Provisions supplemental.
This chapter is in addition to and supplements federal, state, and other fire codes and ordinances. (Ord. 2024-016 § 1 (Exh. A); Ord. 559 § 1, 1989)
8.30.040 Violation – Penalty.
Any person convicted of a violation of this chapter, or any part thereof, is guilty of a misdemeanor and subject to the fines and penalties under state law for misdemeanor offenses. (Ord. 2024-016 § 1 (Exh. A); Ord. 559 § 1, 1989)
8.30.050 Effective date.
The ordinance codified in this chapter is in full force and effect after its passage, approval, and publication as provided by law. (Ord. 2024-016 § 1 (Exh. A); Ord. 559 § 1, 1989)
