OFFENSES UNDER THE SEQUIM CRIMINAL CODE

9.12.010 Leaving child unattended.
No person having custody or control of any child age of eight years or younger may negligently leave the child in or at any place within the city without appropriate supervision for an unreasonable amount of time and without regard for the health, safety, and welfare of the child. This offense will be charged as a misdemeanor and punished by the penalties and fines of a state misdemeanor. (Ord. 2023-17 § 1 (Exh. A); Ord. 2021-013 § 1 (Exh. A); Ord. 357 § 11(15), 1977)
9.12.020 Obstructing a firefighter.
No person may knowingly hinder, delay, or obstruct any firefighter in the discharge of official powers and/or duties. This offense will be charged as a misdemeanor and punished by the penalties and fines of a state misdemeanor. (Ord. 2023-17 § 1 (Exh. A); Ord. 2021-013 § 1 (Exh. A); Ord. 357 § 13, 1977)
9.12.030 Posting of handbills – Unlawfully marking streets and sidewalks.
A. It is unlawful for any person, firm, or corporation to:
1. Post or attach any handbill, circular, advertising matter, or other papers of any kind for advertising or other purposes on any post, fence, tree, building, or other structure in the city except upon billboards or other structures erected for the purpose.
2. Throw, deposit, scatter, or place any handbills, circulars, papers, or other advertising matter upon the streets, alleys, or other public places in the city.
3. Throw, deposit, scatter, or place any handbills, circulars, papers, or other advertising matter upon the walks, yards, porches, or vestibules of any private dwelling in the city. Newspapers and sealed and addressed envelopes are not prohibited under this section.
4. Throw, place, or deposit any handbill, circulars, papers, or any other advertising matter in or upon automobiles without the owner’s consent.
B. Subsection A of this section does not apply to any candidate for political office, their agents, representatives, volunteers, or employees engaged in the distribution of materials and information relative to qualifications for election, or to any person distributing information relative to ballot issues preceding election thereon, or public hearings.
C. No person is allowed to use the streets or sidewalks of the city for the purpose or with the effect of permanently or semi-permanently painting or impressing thereon any picture, sign, mark, letter, or words for advertising purposes, or for any other purpose. The provisions of this subsection do not apply to the officials of the city in painting or impressing markings for traffic control upon the streets or sidewalks of the city.
D. An offense under this section will be charged as a misdemeanor and punished by the penalties and fines of a state misdemeanor. (Ord. 2023-17 § 1 (Exh. A))
9.12.040 Engaging in business without a license.
No person is allowed to engage in business within the corporate limits of the city unless they have complied with Chapter 5.04 SMC and any other relevant law or regulation in city code or state or federal law related to operating the business. This offense will be charged as a misdemeanor and punished by the penalties and fines of a state misdemeanor. (Ord. 2023-17 § 1 (Exh. A))
