NUCLEAR WEAPONS FREE ZONE

9.26.010 Title.
This chapter shall be known as the “Skagit County Nuclear Weapons Free Zone.” (Res. 10491 (part), 1985)
9.26.020 Purpose.
It is the purpose of this chapter that Skagit County shall be and is hereby declared to be a Nuclear Weapons Free Zone, within which all development, testing, transportation, deployment, storage, manufacture or usage of nuclear weapons is prohibited. (Res. 10491 (part), 1985)
9.26.030 Definitions.
For the purposes of this chapter, “nuclear weapons” are defined as bombs or other warheads which derive their force from the fission or fusion of atomic nuclei. Radioactive materials used in medical diagnosis and treatment or other peaceful uses are not affected by this chapter. (Res. 10491 (part), 1985)
9.26.040 Penalties.
Any firm, person, corporation or other entity violating this chapter shall be subject to a civil penalty of one thousand dollars ($1,000.00) per day for each and every violation and be subject to injunction or other remedy of the court to force the specific mandates of this chapter. 9.26.050 Enforcement.
Skagit County may enforce this chapter by bringing appropriate action in the Skagit County Superior Court to seek civil penalties, enjoin or otherwise prohibit violation of this chapter. (Res. 10491 (part), 1985)
9.26.060 Severability.
If any provisions of this resolution or its application to any person, official, firm, corporation or governmental body, or circumstance is held invalid, the remainder of the resolution or the application of its provisions to other persons, officials, firms, corporations or governmental bodies or circumstances, is not affected.
