17.25.010 Requirements for a completed application.

(1) Number of Copies. One original mylar and 20 copies. Standard drawing sheet size is 24 inches by 36 inches.

(2) Application Contents. In addition to the requirements for a completed application as set forth in the consolidated application process, an applicant for a preliminary plat shall submit the following:

(a) Map – Scale. A map or sketch using a scale of 100 feet to one inch or larger, showing:

(i) Topographical and other data depicting:

(A) Boundary lines including bearing and distance;

(B) Easements, including location, width and purpose;

(C) Streets on and adjacent to the tract, including name and right-of-way width and location; type, width and elevation of surfacing, walks, curbs, gutters, culverts, etc.;

(D) Ground elevations on the tract, based on a datum plane approved by the town engineer; for land that slopes less than approximately two percent, show spot elevations at all breaks in grade, along all drainage channels or swales, and all selected points not more than 100 feet apart in all directions; for land that slopes more than approximately two percent, either show contours with an interval of not more than five feet if ground slope is regular and such information is sufficient for planning purposes, or show contours with an interval of not more than two feet if necessary because of irregular land or need for more detailed data for preparing plans and construction drawings;

(E) Other conditions on adjacent land, including approximate direction and gradient of ground slope, including any embankments or retaining walls; character and location of buildings, railroads, power lines, towers, and other nonresidential land uses or platted land within 300 feet of the subject property. Refer to subdivision plat by name, recording date, volume and page number, and show lot size, and dwelling units;

(ii) Utilities on and adjacent to the tract, including location and size of sanitary, storm and combined sewers, location and size of water mains, location of gas lines, fire hydrants, electric and telephone poles, and street lights. If water mains and sewers are not on or adjacent to the tract, indicate the direction and distance to, and size of nearest ones;

(iii) Other conditions on the tract including watercourses, marshes, rock outcrop, and critical areas;

(iv) Zoning district designations, on and adjacent to the tract;

(v) Proposed public improvements, including highways or other mayor improvements planned by public authorities for future construction on or near the tract;

(vi) Vicinity showing location of the tract;

(vii) Sites, if any, to be reserved or dedicated for parks, playgrounds, or other public uses;

(viii) Sites, if any, for multifamily dwellings, shopping centers, churches, industry or other proposed uses exclusive of single-family dwellings;

(ix) Minimum building setback lines;

(x) Site data, including number of residential lots, typical lot size, and acres in parks, etc.;

(xi) Plat name, scale, north arrow and date;

(xii) Typical cross-sections of the proposed grading, roadway and sidewalk;

(xiii) Proposed sanitary, stormwater and water systems plan with points of connection and sizes indicated, or other means to address these concerns;

(b) Title and certificates, including a legal description according to official records in the office of the county auditor, pertinent survey data compiled as a result of a survey made by or under the supervision of a land surveyor registered in the state and engaged in land surveying which contains notation stating acreage, scale, north arrow, datum, bench marks, certification of registered civil engineer or surveyor, date of survey;

(c) Covenants. Draft of proposed covenants, if any. (Ord. 291 § 1(18.45.010), 2000)

17.25.020 Type of approval.

A preliminary plat is approved by the town council based on the recommendation of the planning commission. (Ord. 291 § 1(18.45.020), 2000)

17.25.030 Criteria for approval.

Planning commission shall make an inquiry into the public use and interest proposed to be served by the establishment of the subdivision and/or dedication, and shall consider:

(1) Conformity. Whether the preliminary plat conforms to Chapter 17.40 SMC, General Requirements for Subdivision Approval, and the consolidated application process;

(2) Specific Provisions. If appropriate provisions are made for, but not limited to, the public health, safety and general welfare, for open spaces, drainage ways, streets or roads, alleys, other public ways, transit stops, potable water supplies, sanitary wastes, parks and recreation, playgrounds, schools and school grounds, and shall consider all relevant facts, including sidewalks and other planning features that assure safe walking conditions for students who walk to and from school; and

(3) Public Interest. Whether the public interest will be served by the subdivision and dedication. (Ord. 291 § 1(18.45.030), 2000)

17.25.040 Findings and conclusions.

The town council shall not approve the preliminary plat unless written findings are made that:

(1) Conformity. The preliminary plat conforms to Chapter 17.40 SMC, General Requirements for Subdivision Approval, and the consolidated application process;

(2) Specific Provisions. Appropriate provisions are made for the public health, safety and general welfare and for such open spaces, drainage ways, streets or roads, alleys other public ways, transit stops, potable water supplies, sanitary wastes, parks and recreation, playgrounds, schools and school grounds and all other relevant facts, including sidewalks and other planning features that assure safe walking conditions for students who walk to and from school;

(3) Extension Agreement. A developer extension agreement in accordance with the town’s ordinance on developer agreements for water, sewer, and street facilities has been executed; and

(4) Public Interest. The public use and interest will be served by the platting of such subdivision and dedication. (Ord. 291 § 1(18.45.040), 2000)
