D. A. The responsibility to provide for the proper operation of 800 mHz radios within any commercial or institutional building or premises or portion thereof shall rest with the owner, occupant or other person in possession or control of such building or premises; provided, this chapter shall not be deemed to authorize any condition of any building permit or certificate of occupancy except to obtain a test.
B. No firefighter, police officer or other emergency personnel shall be requested or directed to enter any commercial or institutional building which either has not been tested for the proper operation of 800 mHz radios pursuant to this chapter, or within which the most recent test discloses that 800 mHz radios do not operate properly.
C. The city of Snoqualmie shall not be liable for any damages which may result from the refusal of any firefighter, police officer or other emergency personnel to enter any commercial or institutional building or premises or portion thereof due to failure of the owner to provide for assurance of the proper operation of 800 mHz radios within such building or premises. (Ord. 807 § 1, 1998).
