PUBLIC WORKS AND IMPROVEMENTS

3.45.010 Performance bonds.
Any performance bond required by the city of South Bend for the performance of any work, contract for improvements, materials or labor requiring a performance bond, the successful bidder may, with the consent of the city council, file a bond in the sum of not less than 25 percent of the contract price of any such improvement, and may designate that the same shall be payable to such city. All such persons mentioned in RCW 39.08.010 shall have the right of action on such bond for work done or materials furnished or making of such improvements. (Ord. 940 § 1, 1975).
