13.07.010 Definitions.

A. For purposes of this chapter, “watershed” means the entire land area contributing surface drainage to a specific impoundment point (e.g., Light Creek, Martin Creek or Fleiss Creek).

B. “Impoundment area” means Martin Creek Dam, Light Creek Dam and Fleiss Creek Dam.

C. “Reservoirs” means above-ground tanks used by the city to store potable water. Specifically, Green House Road and Rixon Road tanks, and any future tanks that will be constructed. (Ord. 1476 § 1, 2014).

13.07.020 Restrictions on public access.

It shall be unlawful to enter, cross, camp, drive through, visit or otherwise encroach upon any land or property owned and designated by the city of South Bend as a watershed area, impoundment area or storage tank area. It shall be unlawful to log, cut, remove or otherwise destroy any tree or plant within the designated watershed, impoundment area, or storage tank area without the written permission of the city supervisor/public works director or his/her designee. No person or persons shall build or construct any structure(s) upon any watershed area, impoundment area, or any storage tank area without prior written approval of the city supervisor/public works director. No person or persons shall clear or have cleared any road, lane, path, or motorway without prior written approval of the city supervisor/public works director. (Ord. 1476 § 1, 2014).

13.07.030 Violation – Penalty.

Any person, firm, corporation or association violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor or gross misdemeanor; and for a misdemeanor shall be subject to a fine of not more than $1,000 and imprisonment for a term not exceeding 90 days or both, and for a gross misdemeanor shall be subject to a fine of not more than $5,000 and imprisonment for a term not exceeding one year or both.
