10.16.010 Definitions.
The following words and phrases shall be defined as set out in this section.
A. “Skateboard” means a footboard mounted upon four or more small wheels.
B. “Scooter” means a footboard mounted upon or between two or more small wheels and controlled by an upright steering handle. (Ord. 532, 1989)
10.16.020 Negligent operation.
It is unlawful for any person to operate a skateboard or scooter in a negligent manner upon any roadway, sidewalk or publicly owned parking lot. For the purpose of this section, “to operate in a negligent manner” means the operation of a skateboard or scooter in such a manner as to endanger or be likely to endanger any persons or property. 10.16.030 Unlawful activities.
A. No person shall ride a skateboard or scooter in a commercial or highway business district as defined by the city of Sultan zoning map as amended, except upon private property with the permission of the owner or other person having the authority to control such property.
B. No person shall congregate, meet or assemble with any other person or persons in a manner that results in, creates the substantial risk of, or is intended to:
1. Disrupt or interfere with the passage of persons on any public property or access to such public property from any private property;
2. Disrupt or interfere with access to any private property not owned by or in the legal control of a person physically present at such congregation, meeting or assembly that has the legal right to interfere with access to such private property and who is responsible for and directing the activities of the persons engaged in such interference;
3. Harass or intimidate any person lawfully using any public property;
4. Damage any personal or public property; or
5. Distract persons operating any vehicle on public property.
C. No person shall congregate or assemble for the purpose of engaging in any sporting, hobby or athletic activity on any public property, other than a public park, in a commercial or highway business district as defined by the city of Sultan zoning map as amended, without a special permit issued by the city of Sultan. For the purposes herein, persons running, jogging or bicycling through such an area in the company of other persons engaging in the same activity shall be exempt from the provisions of this subsection.

10.16.040 Parental responsibility.
It shall be unlawful for the parent, guardian or other adult person having custody or control of a minor under the age of 18 years to permit or by inefficient control to allow a violation of this chapter by a minor in his or her custody or control. (Ord. 660-96 § 1; Ord. 532, 1989)
10.16.050 Violation – Penalty.
A. Any person committing a violation of any provision of this chapter shall be guilty of committing a civil infraction which shall be issued in accordance with Chapter 7.80 RCW.
B. A person found to have committed a violation shall be assessed a monetary penalty according to the following scale:
1. First offense, $50.00;
2. Second offense in any one year, $150.00;
3. Third and subsequent offenses in any one year, $250.00.
C. In lieu of payment of the monetary penalty relating to the civil infraction assessed herein, any person receiving a notice of infraction may elect to perform community service at a rate of one hour for each $5.00 of assessed penalty. Community service shall consist of those projects implemented and supervised by the director of public works. In such case, the payment of the penalty shall be deferred pending completion of the community service. (Ord. 677-97; Ord. 660-96 § 1; Ord. 532, 1989)
