PROPERTY ACQUISITION PROCEDURE

3.38.010 Findings.
The city council of the city of Sumner finds that it is in the city’s best interest to establish a unified and consistent procedure for the acquisition of real property for public purposes. (Ord. 2730 § 1 (Exh. A) (part), 2020)
3.38.020 Required prerequisites to property acquisition.
When real property is identified for acquisition, city staff shall gather and determine the following information prior to presentation of the proposed acquisition to city council for final approval:
A. Current zoning of subject property to ensure intended public use is acceptable and appropriate under current or future zoning; and
B. Funding source; and
C. Appraised valuation of the subject property(ies) as determined by an appraisal performed by an MAI appraiser (or equivalent) certified by the state of Washington; and
D. The city council hereby authorizes the mayor, in his discretion, to waive any of the above requirements if, under the circumstances, waiver is appropriate for expediency or emergency acquisition purposes. (Ord. 2730 § 1 (Exh. A) (part), 2020)
3.38.030 Optional additional information.
Depending on the nature of the acquisition and proposed use, it shall be appropriate for city staff to gather and determine the following information, where applicable, prior to closing of any acquisition of real property for public purposes:
A. Official title report to identify any encumbrances;
B. Record of survey;
C. Waiver of retroactivity depending on requirements of funding source;
D. Phase 1 environmental assessment, and subsequent environmental assessments as deemed appropriate;
E. Any and all other due diligence matters, including but not limited to arborist reports, geotech reports, active lease agreements related to property(ies), etc. (Ord. 2730 § 1 (Exh. A) (part), 2020)
