6.08.010 Definitions.

For the purpose of this chapter, certain terms and words are defined as follows: words used in the present tense include the future tense; words in the singular number include the plural number. The word “shall” is mandatory; not directory. Words not defined in this section shall be construed as defined in the zoning ordinance of the City, if defined therein.

A. “Livestock” means any horse, mule, donkey, swine, sheep, goat, cattle or similar animal.

B. “Poultry” means any chicken, duck, goose, turkey or other fowl. [Ord. 1404 § 3, 1983.]

6.08.020 Livestock prohibited – Exceptions.

It is unlawful to keep any livestock within the City, except as permitted in the zoning ordinances of this City. [Ord. 1404 § 3, 1983.]

6.08.030 Poultry prohibited – Exceptions.

It is unlawful to keep any poultry within the City, except as permitted in the zoning ordinances of this City. [Ord. 1404 § 3, 1983.]

6.08.040 Lawful fence defined.

The following shall be considered lawful fences in this City for the purpose of keeping livestock as may be permitted:

A. Post and rail or plank fences, made of sound posts at least five inches in diameter, set substantially in the ground not more than 10 feet apart; rails are to be not less than four inches in diameter, planks are to be not less than one inch thick and six inches wide. Planks or rails are to be securely fastened to posts. Planks or rails shall not be spaced more than nine inches apart.

B. Welded or woven wire stock fences made of 12 and one-half gauge wire with posts substantially set in the ground not more than eight feet apart.

C. When stallions are kept, the fence height shall be a minimum of five feet. All other livestock fences shall be a minimum height of four feet.

D. Any person who may be permitted to keep livestock shall conform to this section. [Ord. 1404 § 3, 1983.]

6.08.050 Enforcement.

It shall be the duty of the Chief of Police or his designee to enforce the provisions of this chapter. [Ord. 1404 § 3, 1983.]

6.08.060 Penalty.

Any person who violates the provisions of this chapter is guilty of a misdemeanor. [Ord. 1404 § 3, 1983.]
