REMOVAL OF ILLEGALLY CONSTRUCTED STRUCTURES

15.50.010 Authority of code enforcement officers to order removal.
Code enforcement officers of the city, upon discovering that a building is being constructed without a permit and/or in violation of any applicable code which renders the structure unsafe or otherwise dangerous, are authorized to order the removal of said structures. [Ord. 1366 § 1, 1982.]
15.50.020 Refusal to remove – City recourse.
If such persons refuse to remove such structure upon the order of the code enforcement officials, the City may proceed to Court to seek compliance with the order. [Ord. 1366 § 2, 1982.]
15.50.030 Refusal to remove – Penalties – Order of removal by Court.
The offender, if found guilty of disobeying the order of the code enforcement officials, shall be subject to a $500.00 fine and/or 90 days in jail, together with an order of the Court requiring the offender to remove the structure within 30 days of the order of the Court. [Ord. 1366 § 3, 1982.]
15.50.040 Neglect to remove within time provided – Additional penalty.
If said structure shall not be removed within the time provided by the Court, the offender shall be subject to the penalties in the amount of $25.00 per day until the structure is removed, together with appropriate findings of the Court for contempt. [Ord. 1366 § 4, 1982.]
