9.19.010 Consent authority.

The police chief of the city of Toppenish is authorized, on behalf of the city of Toppenish, to give written consent to general authority Washington peace officers to exercise law enforcement powers within the city of Toppenish. Any power or authority conferred by consent given in accordance with this section shall be construed as in addition and supplemental to powers or authority conferred by any other law, and nothing contained herein shall be construed as limiting any other powers or authority. 9.19.020 Mutual law enforcement assistance agreements.

The city of Toppenish may enter into mutual law enforcement assistance agreements in the manner provided herein.

A. The Toppenish city council may authorize any law enforcement assistance agreement by resolution.

B. All law enforcement assistance agreements entered into in accordance with this section shall conform to the Washington Mutual Aid Peace Officer Powers Act of 1985, as amended, Chapter 10.93 RCW, and the Washington Interlocal Cooperation Act, as amended, Chapter 39.34 RCW.

C. All law enforcement assistance agreements entered into in accordance with this section may be terminated at any time by the Toppenish city council upon notice to other party or parties to the agreement.

D. All law enforcement assistance agreements entered into in accordance with this section shall be filed with the Toppenish city clerk.

E. The city clerk of the city of Toppenish is authorized and directed to file a copy of each fully executed law enforcement assistance agreement entered into in accordance with this section as may be required by law.

F. The city clerk of the city of Toppenish shall keep a copy of each law enforcement assistance agreement entered into in accordance with this section available for public inspection for as long as it remains in force.

G. Any power or authority conferred by any agreement entered into in accordance with this section shall be construed as in addition and supplemental to powers or authority conferred by any other law, and nothing contained herein shall be construed as limiting any other powers or authority. 9.19.030 Statutory provisions incorporated.

The provisions of the Washington Mutual Aid Peace Officer Powers Act of 1985, as amended, Chapter 10.93 RCW, are adopted by reference as if set forth in full. (Ord. 2006-4 § 1, 2006).
