CRIMINAL ENFORCEMENT OF CODE

1.12.010 General penalty.
A. Unless otherwise provided, any person violating any of the provisions or failing to comply with any of the mandatory requirements of the Tumwater Municipal Code or any rule or regulation adopted pursuant to the city code is guilty of a misdemeanor. Except where the ordinance provides for a different penalty, a misdemeanor is punishable by up to ninety days in jail and up to a $1,000 fine, or both fine and jail. Where an ordinance provides that a violation is a gross misdemeanor, the gross misdemeanor is punishable by up to three hundred sixty-four days in jail and up to a $5,000 fine, or both fine and jail.
B. Each such person is guilty of a separate offense for each and every day during any portion of which any violation of any provisions of the ordinances of Tumwater is committed, continued or permitted by any such person, and he is punishable accordingly.
C. Notwithstanding the provisions contained in subsections A and B of this section, the failure of any officer or employee to perform any official duty imposed by an ordinance of the city shall not subject such officer or employee to the general penalty imposed by this chapter, but the city may by separate ordinance impose penalties for such violations.
D. Enforcement under this section, or any criminal enforcement proceedings, or sanctions of any code provision, is in addition to and does not preclude or limit any other forms of enforcement available to the city including, but not limited to, enforcement under any provision of TMC Chapter 1.10, nuisance actions, actions for injunctions, or any other civil or equitable actions to abate, discontinue, or correct, acts in violation of this code.
