STREET AND SIDEWALK OBSTRUCTIONS

12.08.010 Obstructing streets prohibited.
No person shall deposit, place or put, nor suffer to be deposited, placed or put, by a person or persons in his or her employ, any goods, wares, firewood, coal, lumber, chattels or merchandise of any description whatsoever, in any of the streets, highways, alleys, or other public places of the city, except while counting or shipping the same, or actually removing the same into or out of some building or enclosure, or loading the same into or unloading the same out of some vehicle.

12.08.020 Depositing rubbish or offal in streets prohibited.
No person shall throw or deposit, or cause to be thrown or deposited, in any street, highway or public place in the city, any coal dust, soot, ashes, cinders, shavings, hair, shreds, manure or animal or vegetable matter or substance whatever.

12.08.030 Building materials on sidewalk prohibited.
No person, firm or corporation shall pile any lumber, building blocks, cement or any other type of building materials upon any street, sidewalk, alley or public way within the city.

12.08.040 Tree planting on land platted or reserved for street purposes – Permit required.
No person, firm or corporation shall plant any trees or shrubbery in any area which has been platted or reserved for street purposes or rights-of-way for street purposes, although the same shall not be currently so used, without obtaining a permit so to do; and such permit shall specifically bind the person obtaining such permit to immediately remove such trees or shrubs upon written request of the mayor, city council or public works director, or his/her designee, without any expense to the city.

12.08.050 Construction on land platted for street purposes prohibited.
No building, wall or construction of any kind shall be placed upon any area which is platted or reserved for street purposes.

12.08.060 Violation – Penalty.
Any person violating the provisions of this chapter shall be guilty of a misdemeanor. Each day of continuing violation will be considered a separate offense.
