BOARD OF ADJUSTMENT

(1) There is hereby created a town board of adjustment, consisting of five members, who shall be appointed by the mayor and confirmed by the town council, none of which members shall hold any other office in the municipality. All members of the board of adjustment shall be legal residents of the town of Twisp.
(2) The terms of office for the first appointive members shall be two years for two members, and three years for three members, such terms to expire on the first day of September, 1979 and 1980, respectively. The terms of the first appointive members shall be fixed and designated by the mayor at the time of their appointment. Thereafter the term of office for each appointive member shall be three years.
(3) Vacancies occurring otherwise than through the expiration of terms shall be filled for the unexpired term. Members may be removed, after public hearing, by the mayor, with the approval of the town council, for inefficiency, misfeasance or malfeasance in office. The members shall be selected without respect to political affiliations and they shall serve without compensation. (Ord. 232 § 1, 1977)
2.40.020 Powers and duties.
The board of adjustment shall have all of the powers and perform each and all of the duties allowed by RCW 35.63.080 and conferred upon them by the Twisp zoning ordinance, now and as hereafter amended, together with any other duties or authorities which may hereafter be conferred upon them by proper and lawful action of the town council as authorized by the laws of the state of Washington, and subject to each and all the limitations expressed in such town ordinances or in such state legislative enactments, now or as hereafter amended. 2.40.030 Officers.
The board shall elect its own chairperson and create and fill such other offices as it may determine it requires. The board may designate one of its members to act as secretary without salary, or if requested by the board, the mayor shall designate a member of the paid staff of the town to serve as such secretary, who shall serve without additional compensation. 2.40.040 Quorum.
(1) Three members of the board shall constitute a quorum for the transaction of business.
(2) Any action taken by a majority of those present, when those present constitute a quorum, at any regular or special meeting of the board shall be deemed and taken as the action of the commission. (Ord. 239 § 1, 1979; Ord. 232 § 4, 1977)
2.40.050 Record keeping.
The board shall keep a written record of its meetings, resolutions, transactions, findings and determinations, which record shall be a public record. The board, at or before its first regular meeting in September of each year, shall make a full report in writing to the town council of such transactions and expenditures, if any, for the preceding year.
