5.15.010 License required.

(1) The purpose of this chapter is to regulate and control the operation of certain machines known as pinball machines or other similar mechanical devices wherein coins are deposited by a player, and which machines either by the element of skill, or by the combination of elements of skill and chance, or by the element of chance alone determined a payout or reward to the player.

(2) It is hereby determined that it is unlawful to operate or maintain in the town of Twisp any such machine unless a license is first procured, as provided in this chapter. Licenses for no more than five such machines may be outstanding at any time regardless of whether or not the holders of such licenses maintain the licensed machines in active operation, and regardless of whether all licenses are currently held by one or by more than one individual, firm or corporation.

(3) The license required by this chapter is separate from and in addition to the business license issued under Chapter 5.25 TMC, which may also be required when applicable. (Ord. 784 § 1(C), 2022; Ord. 62 § 1, 1941)

5.15.020 License duration – Fee.

The licenses authorized to be issued pursuant to this chapter shall license each machine for a period of not less than one year, and the license fee for each machine shall be $60.00 per year, payable quarterly in advance, and if ensuing quarterly payments are not paid when due, the license currently issued for such machine shall be deemed terminated as of the end of the quarter for which the license fee shall have been paid. 5.15.030 Conditional right to renewal or extension.

The holder of any license under this chapter, or his assignee, shall have the prior right to the renewal or extension thereof for the ensuing year, provided the holder of any such license has applied for license for the ensuing year at least 10 days before the expiration of the license currently in effect. 5.15.040 Violation – Penalty.

Any person operating any machine required to be licensed by this chapter without having procured a license therefor shall be deemed guilty of misdemeanor and upon conviction thereof shall be subject to a fine of not to exceed $100.00 and each day’s violation of this chapter shall constitute a separate offense.
