10.19.010 Applicability of regulations – Parent or guardian responsibility.
A. It is unlawful for any person to do any act forbidden or fail to perform any act required in this chapter.
B. These regulations applicable to bicycles shall apply whenever a bicycle is taken, operated, or ridden upon any street, upon public property, or upon a public path set aside for the exclusive use of bicycles, subject to those exceptions stated herein.
C. The parent of any child and guardian of any ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this chapter. (Ord. 2000-19 § 2, 2000: Ord. 95-20 § 1(part), 1995).
10.19.020 Bicycle – Included within definition.
The term “bicycle” shall be deemed to include the terms “unicycle” and “adult-size three-wheel cycle.” (Ord. 95-20 § 1(part), 1995).
10.19.030 License required.
No person shall ride or propel a bicycle on any street or upon any public path set aside for the exclusive use of bicycles unless such bicycle has been licensed and a license is attached thereto as provided herein. (Ord. 95-20 § 1(part), 1995).
10.19.040 License application – Fee – Duplicate license.
Application for a bicycle license shall be made upon a form provided by the city and shall be made to the police chief or designee. A one-time license fee of five dollars shall be paid to the city by an applicant for each bicycle before each license is granted. A duplicate license may be supplied for the same cost as the original plate in event of loss of the license. (Ord. 95-20 § 1(part), 1995).
10.19.050 License – Issuance authority – Period of validity – Recordkeeping required.
A. The police chief or designee, upon receiving proper application therefor, is authorized to issue a bicycle license which shall be effective for the applicant’s ownership of the bicycle.
B. The police chief or designee shall not issue a license for any bicycle when he knows or has reasonable ground to believe that the applicant is not the owner of, or entitled to the possession of, such bicycle.
C. The police chief or designee shall keep a record of the number of each license, the date issued, the name and address of the person to whom issued, the number of the frame of the bicycle for which issued, and a record of all bicycle license fees collected by him. (Ord. 95-20 § 1(part), 1995).
10.19.060 License – Bicycle inspection prerequisite to issuance.
The police chief or designee shall inspect each bicycle before licensing the same and shall refuse a license for any bicycle which he determines is in unsafe mechanical condition. (Ord. 95-20 § 1(part), 1995).
10.19.070 License plate – Issuance authority – Attachment to bicycle required.
A. The police chief or designee, upon issuing a bicycle license, shall also issue a license plate, decal or other form of license bearing the license number assigned to the bicycle and the name of the city.
B. The bicycle owner shall cause such license to be attached firmly to the bicycle for which issued.
C. No person shall remove a license from a bicycle during the period for which issued except upon a transfer of ownership or in the event the bicycle is dismantled and no longer operated upon any street in this city. (Ord. 95-20 § 1(part), 1995).
10.19.080 Safe operation.
No bicycle shall be operated faster than is reasonable and proper, and every bicycle shall be operated with reasonable regard for the safety of the rider and of other persons and property. (Ord. 95-20 § 1(part), 1995).
10.19.090 Racing – Prohibited without permit.
It is unlawful for any person to run, or engage, or cause to run or be engaged in, any bicycle race on any street, alley or public place within the corporate limits of the city except under permit from and under the supervision of the chief of police of the city. (Ord. 95-20 § 1(part), 1995).
10.19.100 Riding on sidewalks – Procedures required – Prohibited where.
A. No person shall ride a bicycle upon a sidewalk within a business district.
B. Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian. (Ord. 95-20 § 1(part), 1995).
10.19.105 Bicycles prohibited upon skate park.
No person shall take, operate, or ride a bicycle upon the skate park located at Fort Walla Walla Park. (Ord. 2000-19 § 1, 2000).
10.19.110 Impoundment – Authorized when – Procedure.
Any bicycle which is found in a public place in the city, whether or not the bicycle is accompanied by its owner or operator, which is not properly licensed or which is not properly equipped or which is being operated in violation of the terms of this chapter may be impounded by a police officer for a period of thirty days. Such impounded bicycle may be retained by the police department until the police chief or designee is assured that the bicycle has been properly equipped and licensed in accordance with the provisions of this chapter or will be so equipped and licensed prior to its operation. The action of the police in impounding a bicycle as provided in this section shall be conclusive and final. The impounding of a bicycle shall not preclude the imposition of any other penalty provided herein upon the person whose bicycle is impounded. (Ord. 95-20 § 1(part), 1995).
10.19.120 Violation – Penalty – License suspension authorized.
Every person, firm or corporation violating any of the provisions of this chapter shall, on conviction thereof, be guilty of an infraction and shall be punished as set forth in Section 1.24.010 of this code. In addition thereto, the court may suspend the license for the bicycle for a period not to exceed thirty days. The police department, for the period of suspension, shall impound the bicycle for which the license has been suspended. (Ord. 95-20 § 1(part), 1995).
