5.08.010 Junk defined.
A. “Junk,” as used in this chapter, means old rope, old iron, copper, tin, lead, rubber, rags, empty bottles, paper, bagging, sacks, parts of machinery including automobile parts, parts of stoves, scrap metals of all kinds, and such other worn out or discarded articles and materials and odds and ends as can be turned to some use; but shall not be deemed to include and mean furniture, house furnishings, goods, clothing, machinery or tools which can be used again for the purpose for which they were originally intended.
B. “Junk” does not mean parts used to reassemble vehicles or other items, and those persons purchasing parts or items to reassemble or assemble items for sale are not “junk dealers” as contemplated by this chapter. However, “motor vehicle wreckers,” as defined in Section 17.02.020, are to be considered “junk dealers” under this chapter. (Ord. 1163(part), 2007)
5.08.020 Purchasing junk from certain persons prohibited.
It is unlawful for any junk dealer to purchase any junk from any minor under the age of eighteen years or from any person or persons appearing to be intoxicated, or from any person known to be a notorious thief or to have been indicted or charged with larceny or burglary. (Ord. 1163(part), 2007)
5.08.030 Hours of purchasing restricted.
It is unlawful for any junk dealer to purchase any junk between the hours of nine p.m. and seven a.m. (Ord. 1163(part), 2007)
5.08.040 Refusing police inspection prohibited.
It is unlawful for any junk dealer to refuse to allow any police officer or code enforcement officer to inspect his or her place of business and all articles and things kept therein whenever such officer shall deem it necessary to do so. If any junk dealer refuses to allow any police officer or code enforcement officer to inspect his place of business and its articles, he shall be guilty of a misdemeanor, punishable by up to ninety days in jail, a one thousand dollar fine, or both. 5.08.050 Employer liability for employee’s acts.
The act of the servant or employee of a junk dealer shall be deemed to be the act of the employer. (Ord. 1163(part), 2007)
