YARD SALES AND GARAGE SALES

5.12.040 Yard sale limitations.
5.12.010 Definitions.
“Yard sales” and “garage sales” shall mean and include all sales entitled “yard sale,” “garage sale,” “lawn sale,” “attic sale,” “rummage sale,” or any similar casual sale of tangible personal property which is advertised by any means whereby the public at large is or can be made aware of said sale, by a person who is not a secondhand dealer as defined in Section 5.10.010. Yard sales are not limited to those sales at persons’ homes, but also include yard sales conducted by nonprofit organizations, churches, and other like entities. (Ord. 1163(part), 2007)
5.12.020 Restrictions upon advertising yard sales and garage sales--Signboards--Violations and penalties.
A. It is unlawful for any person who conducts a yard sale or a garage sale to advertise such sale by posting, placing or in any manner displaying a sign, notice or advertisement thereof on any utility pole within the city limits, or within any public right-of-way, or upon property owned by the city.
B. All yard sale advertisement signs shall be removed within two days from any other property onto which such sign is affixed.
C. A violation of this section shall be punishable by a fine as set forth in a fee resolution. (Ord. 1163(part), 2007)
5.12.030 Yard sale permits.
A “yard sale” is defined as a sale of personal property located on the property or in conjunction with the owner of the property, or a sale of personal property of a group of people such as a church yard sale or other nonprofit yard sale wherein a number of persons bring their personal property to one location for resale. Persons conducting yard sales shall first obtain a yard sale permit from the city clerk/treasurer and pay a permit fee. The permit fee and permit shall be paid and obtained before the date of the yard sale. (Ord. 1163(part), 2007)
5.12.040 Yard sale limitations.
Yard sales shall be limited to a maximum of three days in length in any one instance. There shall be a limit of two yard sales per location, or per nonprofit or other entity, per year. Violation of this section shall be punishable by a fine not to exceed one hundred dollars. (Ord. 1163(part), 2007)
