GENERAL PENALTY1

1.16.010 Violation.
A. Criminal Penalty. Unless otherwise provided, any person violating any of the provisions of the West Richland Municipal Code or failing to comply with mandatory requirements of this code is guilty of a gross misdemeanor. Any person convicted of a gross misdemeanor under this code shall be punished by a fine not to exceed $5,000 or by imprisonment not to exceed one year, or by both such fine and imprisonment.
B. Civil Penalty. Any person violating any of the provisions of this code or failing to comply with any of the mandatory requirements of this code which is designated a civil offense shall have committed a civil infraction. Unless otherwise provided, any such person shall be assessed a monetary penalty not to exceed $250.00 for each day the violation occurs. [Ord. 47-06 § 1, 2006; Ord. 291 § 1, 1979].
1.16.020 General penalties.
Any person, firm or corporation convicted of violating any ordinance or municipal code provisions shall be punished in accordance with the provisions of WRMC 9.04.030; provided, however, that if an ordinance or municipal code provision recites that a violation of the ordinance or code provision is an infraction, then the penalty for committing the infraction shall be a fine not to exceed $250.00; provided further, that crimes involving the operation of a motor vehicle established in RCW Title 46 as adopted by the West Richland Municipal Code pursuant to Chapter 46.90 RCW shall have the penalties established by those statutes. 1.16.030 Violation – Separate offense.
Each person violating any of the provisions or failing to comply with any of the mandatory requirements of any ordinances of the city is guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the city is committed, continued or permitted by any such person, and he is punishable accordingly.
