PUBLIC OPEN SPACES

16.12.010 Purpose of chapter.
The purpose of the ordinance codified in this chapter is to provide for public open spaces within the city to be used as park, recreation areas, and natural spaces. [Ord. 14-00 § 1, 2000; Ord. 264 § 1, 1978].
16.12.020 Definitions.
For the purpose of this chapter, the following definitions are applicable:
“Current fair market value” is the current fair market value of the property after installation of improvements such as streets, curbs, sidewalks, gutters and utilities, but before construction of a residential unit on the property.
“Subdivider” is any person, firm, or corporation undertaking the subdivision or re-subdivision, platting or re-platting, or short platting of any lot, block, or other parcel of land to be used for residential purposes. [Ord. 14-00 § 1, 2000; Ord. 264 § 2, 1978].
16.12.030 Required – Proposal submission procedure.
A. Every subdivider in his plat, subdivision or short plat shall provide for open public spaces for parks, playgrounds and recreation areas in accordance with the standards set forth in this chapter.
B. Each subdivider has the option to propose (1) payment of park impact fees, and/or (2) the construction of park facilities, and/or (3) the dedication of land in lieu of park fees in accordance with the city’s adopted park master plan to the West Richland city park board for review prior to submission by the subdivider of his plat, subdivision or short plat to the planning commission. The park board shall review the subdivider’s proposed dedication and provide to the planning commission its written recommendation of acceptance or rejection of the proposal and the reasons therefor.
