1.04.010 Designated.

(1) Any person violating any of the provisions or failing to comply with any of the mandatory requirements of the ordinances of Westport shall be guilty of a misdemeanor, unless it is designated as a gross misdemeanor.

(2) Any person convicted of a misdemeanor under the ordinances of Westport shall be punished by a fine of not more than $500.00, or by imprisonment not to exceed six months, or by both such fine and imprisonment.

(3) Any person convicted of a gross misdemeanor under the ordinances of Westport shall be punished by a fine of not more than $5,000, or by imprisonment not to exceed one year, or by both such fine and imprisonment.

(4) It shall be a separate offense for each and every day, or any portion thereof, during which any violation of any provision of the ordinances of Westport is committed, continued or permitted. (Ord. 895 § 3, 1992; Ord. 343 § 1, 1969)

1.04.020 Failure to pay fine, costs.

Upon the rendition of judgment against any defendant for violation of any ordinance of this town, the police magistrate or justice of the peace shall make an order and enter the same upon his docket, that if the defendant shall neglect or refuse to satisfy such judgment and costs of suit, he shall be confined in the town jail or other place of confinement provided for that purpose, one day for each $10.00 of such judgment and costs, and during such confinement he may be required to labor upon the streets or do other work for the town under the supervision and direction of the marshal. Execution shall be issued immediately upon the rendition of judgment. (Ord. 343 § 2, 1969)

1.04.030 Community service substituted for jail time.

Persons convicted of misdemeanors in the city municipal court may perform community service work in lieu of jail time in the discretion of the court. Community service work to be performed shall be performed under the direction of the superintendent of public works. The defendant shall receive credit for one day of jail time for each eight hours of community service work performed; provided further, that the city shall pay to the Department of Labor and Industrial Insurance premiums for said persons while they are performing services for the city.
