CITY PARTICIPATION IN LATECOMER AGREEMENTS FOR WATER AND SEWER

13.20.010 Purpose.
The purpose of this chapter is to allow the city to participate in financing the development of water or sewer facilities development projects authorized by and in accordance with RCW 35.91.020. (Ord. 1482 § 4, 2010)
13.20.020 Authority.
Unless otherwise provided by or prohibited by other ordinance or contract, the city may contribute to the financing of water or sewer facilities projects and will have the same rights to reimbursement as property owners or developers of real estate under Chapter 13.18 WMC. If the project or projects are jointly financed by a combination of municipal funding and private funding by property owners or developers of real estate, the amount of reimbursement received by each participant in the financing must be a pro rata share. The city may, at its sole discretion, finance water or sewer facilities projects and seek reimbursement of cost by establishing a latecomer agreement in accordance with this chapter.
