10.32.010 Permit required.

Any individual, firm or corporation planning to move, transport or haul any mobile home or other structure over 10 feet in width or 35 feet in length through Whatcom County on any route which consists solely of county roads and highways shall, prior to said movement or transport, obtain a permit from the Whatcom County engineer. (Ord. dated 11/20/75 (part); prior code § 7.06.010).

10.32.020 Requirements for issuance.

The county engineer, or his authorized agent, prior to the issuance of a permit for oversize mobile homes or other structures shall:

A. Designate the route to be followed;

B. Determine what other conditions or restrictions relating to the movement are necessary to insure the safest possible conditions and to maintain the normal flow of traffic;

C. Require the payment of the per mobile home, convoy or structure permit fee as set forth in the Whatcom County Unified Fee Schedule; and

D. Determine whether, and in what amount, a bond or other undertaking for security is necessary to insure compensation to the county for damage that may result to road foundations, surfaces, signs or structures, and to then require that such bond or other security be provided in a form satisfying the engineer. 10.32.030 Time for application.

The application for the permit required by this chapter shall be in writing on special forms provided by the county engineer and shall be submitted at least 12 hours in advance of the proposed movement; provided, that where the permit is sought for the movement of a mobile home or structure and the movement is to terminate in Whatcom County, the application for permit must be submitted at least 36 hours in advance. All applications for permits for the movement of structures shall be submitted at least 36 hours in advance, without regard to destination. (Ord. dated 11/20/75 (part); prior code § 7.06.030).

10.32.040 Notification of other county agencies.

The engineer shall notify the Whatcom County sheriff of the issuance of any permit, and, prior to the issuance of a permit for a movement terminating in Whatcom County, the engineer shall notify the county assessor and the county building official to ensure compliance with other pertinent ordinances, regulations or laws. 10.32.050 Contents and display of permit.

Every permit issued under this chapter shall specifically describe the mobile home or structure covered by the permit, the route to be utilized, other conditions imposed, and the destination of the movement. Every permit shall be carried in the vehicle or combination of vehicles for which it was issued and shall be open to inspection by any peace officer or any authorized agent of the engineer. 10.32.060 Exemptions from payment of fee.

The fee required by this chapter shall not be imposed upon any mobile home or structure owned by the state or by Whatcom County or by any city, town or county within the state, or by the Government of the United States. (Ord. dated 11/20/75 (part); prior code § 7.06.060).

10.32.070 Other licenses.

Compliance with this chapter is separate from and in addition to all other regular license and tonnage fees. (Ord. dated 11/20/75 (part); prior code § 7.06.070).

10.32.080 Violations – Penalties.

Any person, firm or corporation failing to comply with the requirements of this chapter, or failing to comply with any conditions attached to any permit, is guilty of a misdemeanor and any person, firm or corporation who misrepresents the size or length of any mobile home or structure in making application for a permit shall be guilty of a misdemeanor, and, upon conviction, shall be fined not less than $100.00 and not more than $150.00.
