PET SHOP RULES AND REGULATIONS

24.10.010 Authority.
Pursuant to RCW 70.05.060 these rules and regulations are adopted for the purpose of implementing and enforcing WAC 248-100-440 and -450 rules and regulations of the Washington State Board of Health. (Ord. 90-123 (part)).
24.10.020 Rules adopted.
WAC 248-100-320 Salmonellosis, 248-100-440 psittacosis and 248-100-450 rabies sections of WAC 248-100 Communicable and Certain Other Diseases as presently adopted and hereafter amended are hereby adopted by reference. (Ord. 90-123 (part)).
24.10.030 Definitions.
For purposes of this chapter:
“Board of health” means Whatcom County council.
“Health officer” means the legally designated health officer as defined in RCW 70.05.010(12) or his authorized representative.
“Pet shop” means any establishment or premises maintained for the purchase, sale or exchange of pets of any type, other than fish.
“Psittacine bird” includes all birds commonly known as parrots, macaws, cockatoos, lovebirds, parakeets and all other birds of the order psittaciformes. (Ord. 90-123 (part)).
24.10.040 Permits.
A. No person shall operate a pet shop unless an annual permit has been issued by the health officer.
B. The health officer is authorized to make such inspections as are necessary to determine satisfactory compliance with the provisions of this chapter.
C. Upon written notice to a pet shop operator, the health officer may suspend or revoke the permit of a pet shop or take such other action as the health officer may deem necessary whenever the health officer finds the pet shop is not in compliance with these regulations. (Ord. 90-123 (part)).
24.10.050 Operations.
A. Viable turtle egg(s) or live turtle(s) with a carapace length less than four inches shall not be offered for sale or given away.
B. All psittacine birds except parrots, macaws, and cockatoos shall be identified by a coded closed leg band which shall identify the breeder source and the individual bird.
C. Psittacine birds shall not be offered for sale or exhibited unless placed in an enclosure which will effectively protect the public against direct exposure to the birds or dust particles which emanate from the pen or cage in which they are kept.
D. Skunks, fox and raccoons may not be kept on the premises or offered for sale.
E. All cages, pens and storage areas shall be kept in a clean and sanitary condition free from insects and rodents.
F. Toilet and handwashing facilities with hot and cold running water, soap and single use or approved sanitary towels or other approved hand drying devices shall be provided for the employees. (Ord. 90-123 (part)).
24.10.060 Fees.
A. Permit fees shall be established yearly by the board of health and shall be based on the cost of the inspection service.
B. The initial annual permit fee shall be $62.00. (Ord. 90-123 (part)).
24.10.070 Severability.
If any provision of this regulation or its application to any person or circumstance is held to be invalid, the remainder of the regulation or the application of the provisions through other persons or circumstances is not affected. (Ord. 90-123 (part)).
