9.05.010 Criminal statutes adopted.

The following Washington State Codes, as now enacted or hereafter amended or additions made thereto, are hereby adopted by reference, including all applicable penalty provisions therein, as and for the criminal code ordinance of the Town of Wilkeson as if set forth in full herein:

A. RCW Title 9 entitled “Crimes and Punishments.”

B. RCW Title 9A entitled “Washington Criminal Code.” [Ord. 335 § 2, 1987].

9.05.020 Session laws adopted.

A. The following chapters of the 1988 Session Laws of the Fiftieth Washington State Legislature as these chapters apply to RCW Titles 9 and 9A are hereby adopted by reference including all applicable penalty provisions therein, as and for amendments or additions to the Criminal Code Ordinance of the Town of Wilkeson as if set forth in full herein:

1. Chapters 3, 33, 36, 60, 62, 112, 120, 143, 145, 146, 151, 153, 154, 155, 157, 158, 202, 206, 218, 219, 223, 224, and 266.

B. The following chapters of the 1988 Session Laws of the Fiftieth Washington State Legislature, as they apply to Chapters 46.61 and 46.90 RCW, are hereby adopted by reference including all applicable penalty provisions therein, as and for amendments or additions to the Criminal Code Ordinance of the Town of Wilkeson as if set forth in full herein:

1. Chapters 24 and 74.

C. One (1) copy of the above referred chapters shall be available at the Town Hall Office during regular office hours for review by members of the public. [Ord. 88.15 §§ 1, 2, 4, 1988].

9.05.030 State Infraction Penalty Schedule adopted.

The Town Council:

A. Hereby adopts by reference the State Infraction Penalty Schedule and requires the penalty for any criminal ordinance to be the same as a State penalty for the same crime.

B. Directs the court to dedicate ten dollars ($10.00) from every traffic and civil infraction penalty collected into a separate judicial information system account.

C. Adopts the Supreme Court Rule IRLJ 6.2 to increase the base penalties of most State infractions by ten dollars ($10.00). The increase in base penalty is subject to the Public Safety Education Assessment (PSEA). [Ord. 94.5 §§ 1 – 3, 1994].

9.05.040 Domestic Violence Protection Act.

A. There is hereby established under this chapter crimes involving domestic violence.

B. The Domestic Violence Protection Act, Chapter 26.50 RCW, is hereby incorporated by reference together with any future amendments and/or modifications.

C. There is hereby incorporated by reference Chapter 10.99 RCW, domestic violence, together with all future amendments and modifications thereto.

D. There is hereby incorporated by reference RCW 9A.36.150, Interfering with the reporting of domestic violence, together with all future amendments and/or modifications thereto.

E. The penalty for violations of the above, where classified as a misdemeanor, is ninety (90) days’ incarceration and/or a one thousand dollar ($1,000) fine. For the crimes set forth above, which classify as a gross misdemeanor, the penalty is three hundred sixty-five (365) days’ incarceration and/or a five thousand dollar ($5,000) fine. The foregoing are maximum penalties. [Ord. 2008.07 §§ 1 – 5, 2008; Ord. 284 § 1, 1985].

9.05.050 Nuisance statutes adopted.

A. Does hereby incorporate by reference Chapter 9.66 RCW, Public Nuisance, and all amendments and modifications thereto, including penalties.

B. A misdemeanor shall be punishable by a maximum of ninety (90) days in jail and/or one thousand dollar ($1,000) fine.

C. A gross misdemeanor shall be punishable by a maximum of three hundred sixty-five (365) days in jail and a five thousand dollar ($5,000) fine. [Ord. 2011.05 §§ 1 – 3, 2011].
