WATER AND SEWER DEPOSITS AND DELINQUENT ACCOUNTS

13.15.020 Procedure on delinquent accounts.
13.15.010 Deposit.
The following deposit is required on a water and/or sewer utility account when the applicant for the account is not the owner of the real estate for which the account is to serve:
A. Upon the application of a person who is not the owner of the real estate for which water and/or sewer is being requested, that person shall deposit with the Town, at the time of application, an amount as set forth by fee schedule.
B. The deposit set forth in subsection (A) of this section shall be held by the Town as security for payment of the utility charges.
C. Upon receipt of notice from the applicant referred to above indicating that the account is to be terminated, the Town shall refund the deposit referred to above less any utility charges that are due.
D. Notwithstanding the above deposit, the Town retains the right to terminate utility service by a shutoff if the account is delinquent pursuant to provisions set forth below. [Ord. 2015.01 § 2, 2015].
13.15.020 Procedure on delinquent accounts.
A. The utility bills for water service are to be mailed on the first day of the month for the amount incurred for the prior month. An account not paid by the end of the same month in which the billing statement was sent shall be determined delinquent.
B. There will be a charge in an amount set forth in the fee resolution for delinquent accounts, and a notice shall be sent to the delinquent account informing them that the utility service will be disconnected if payment is not received by the fourteenth of the month following the notice of the billing.
C. In the event of a delinquency that is not resolved, the Town shall file a lien against the property in the amount of the delinquency, late fees as established in the fee resolution, attorney fees and costs, which amount must be paid by the customer for the utility to be reinstated plus a turn on fee as set forth in the fee resolution.
D. Any deposits may be forfeited to pay the delinquencies, in which case the customer must re-establish the deposit amount prior to the utility being restored. [Ord. 2015.01 § 3, 2015].
