SKATEBOARDS, ROLLER SKATES AND COASTERS

10.28.010 Definitions.
The following words and phrases when used in this chapter shall, for the purposes of this chapter, have the meanings respectively ascribed to them in this section:
“Bicycle” means every device propelled solely by human power upon which a person or persons may ride having two tandem wheels, or three wheels.
“Coaster” means a foot board mounted upon two or more wheels and controlled by an upright steering handle. This device is propelled by the user in usually an upright position.
“Operate in a negligent manner” means the operation of one or more of the above-described devices in such a manner as to endanger or be likely to endanger any person or property. Examples of operating in a negligent manner include, but are not limited to, failure to obey all traffic-control devices and failure to yield right-of-way to pedestrians and/or vehicular traffic.
“Roller skate/blade” means a pair of shoes/boots, mounted upon wheels and is most often propelled by the user in an upright, standing position or kneeling.
“Skateboard” means a foot board mounted upon four or more wheels and is usually propelled by the user who sometimes stands, sits, kneels or lays upon the device while it is in motion. (Ord. 448 § 1, 1995)
10.28.020 Traffic regulations.
Any person operating a skateboard, roller skates/blades or a coaster shall obey the instructions of official traffic-control signals, signs and other control devices applicable to vehicles, unless otherwise directed by a police officer. (Ord. 448 § 2, 1995)
10.28.030 Speed.
No bicycle, skateboard, roller skates/blades or coaster shall be ridden in a negligent manner but shall be operated with reasonable regard for the safety of the operator and other persons. (Ord. 448 § 3, 1995)
10.28.040 Operation prohibited where.
A. It is unlawful for any person to operate or ride a skateboard, roller skates/blades or coasters upon sidewalks, publicly owned parking lots and streets within the central business district of the town, including SR 20 and from the 300 block of Riverside Avenue to Bluff Street, and the 100 block of Bridge Street.
B. It is unlawful for any person to operate or ride a bicycle upon sidewalks within the central business district to the town, including SR 20, and from the 300 block of Riverside Avenue to Bluff Street, and the 100 block of Bridge Street. (Ord. 448 §§ 4, 5, 1995)
10.28.050 Exemption.
Exempted from this chapter will be any Winthrop marshal’s bicycle patrol officer/his or her bicycle while in performance of their official duties. (Ord. 448 § 6, 1995)
10.28.060 Violation—Penalty.
Any person violating any provision of this chapter shall be guilty of an infraction and shall be punished by the imposition of a monetary penalty of not more than one hundred dollars ($100.00). Further, the device ridden at the time of violation shall be subject to impound for a period of ten (10) days. (Ord. 448 § 7, 1995)
