7.04.010 Title of provisions.
This chapter shall be referred to as the Woodway penal code and reference to the "Town" in this title means the Town of Woodway. (Ord. 100 § 1.1, 1979)
7.04.020 Public officer defined.
A "public officer" includes the following when acting in their official capacity: Police Officers, Health Officer, Director of Public Works, Building Official, Town Engineer, or their duly authorized deputies, Mayor and Council Members. (Ord. 01-412 § 1 (Exh. 1(part)), 2001: Ord. 100 § 1.4, 1979)
7.04.030 Violation--Penalty.
A. Violation of the Town penal code shall constitute a misdemeanor and shall be prosecuted by the Town or be redressed by civil action or both at the option of the Town.
B. Except as otherwise specifically provided for in this title, any person violating this title or any such provision thereof, shall, upon conviction, be punished by a fine of not more than five thousand dollars or by imprisonment for not longer than one year, or by both such fine and imprisonment.
C. Each such person is guilty of a separate offense for each and every day during any portion of which any violation of this title is committed, continued or permitted by any such person, and he or she is punishable accordingly. (Ord. 192 § 3, 1987: Ord. 100 § 51.2, 6.1, 1979)
7.04.040 Violation--Cost recovery.
Upon conviction of an offense under the town penal code the defendant shall pay the costs of prosecution in addition to the sentence imposed by the court. "Costs of prosecution" includes docketing, cost of issuing the warrant for arrest, mileage and service of the warrant for arrest, witness fees and court costs as assessed under the District Justice Court system.
