8.40.010 Purpose.
The village board finds that from time to time persons establish campsites, for the purpose of maintaining a temporary or permanent place to live, on sidewalks, public rights-of-way, under bridges, in vehicles, and on private property. Such actions create unsafe and unsanitary living situations which pose a threat to the peace, health or safety of those persons camping and other citizens of the village. Further, such actions interfere with the rights of others to use public areas for the purposes for which they were intended. [Ord. dated 11/2/21 § 1].
8.40.020 Definitions.
“Camping unit” means any portable device, no more than 400 square feet in area, used as a temporary shelter, including but not limited to a camping trailer, motor home, bus, van, pickup truck, motor vehicle, tent or other mobile recreational vehicle.
“Campsite” means any place where any bedding, sleeping bag or other sleeping matter is placed, established or maintained, whether or not such place incorporates the use of any tent, lean-to, shack or any other structure, or any vehicle or part thereof.
“To camp” or “camping” means to set up or to remain in or at a campsite.
“Village property” means any property which is owned or leased by the village of Arena, including property in which the village of Arena is a land contract vendee, and all municipal easements or rights-of-way. [Ord. dated 11/2/21 § 1].
8.40.030 Camping on private property.
No person shall camp or take temporary habitation on the property of another without the permission of a person lawfully in control of the property. Camping units shall not be used for dwelling purposes, except for overnight sleeping for a maximum of 14 days in any one calendar year. [Ord. dated 11/2/21 § 1].
8.40.040 Camping on village streets and other property.
It is unlawful for any person to camp or establish a campsite in or upon any village street, right-of-way or property, except by declaration by the village president or village board in emergency or other special circumstances. [Ord. dated 11/2/21 § 1].
8.40.050 Penalty.
Any person violating any provision of this chapter shall, upon conviction, be subject to a forfeiture of not less than $50.00 nor more than $500.00 for each offense, and upon failure to pay the same shall be confined in the county jail for not more than 30 days. [Ord. dated 11/2/21 § 1].
