6.04.010 Animals and poultry not to run at large.

No person having in his possession or under his control any animal or fowl shall allow the same to run at large within the city. (Prior code § 9.17)

6.04.020 City declared bird sanctuary—Cruelty to or trapping of animals and birds prohibited.

A.    The city is designated as a bird sanctuary.

B.    No person except a peace officer or health or humane officer in the pursuit of his duties shall, within the city, shoot, kill or trap any animal or bird or disturb any bird’s nests or bird’s eggs. Trapping of animals with noninjurious box traps on an owner’s premises for removal and release elsewhere shall be permitted.

C.    No person shall commit an act of cruelty on any animal or bird.

D.    If starlings or similar birds congregate in such numbers in a particular locality as to constitute a nuisance or menace to health or property in the opinion of the proper authorities of the city, the Elmbrook Humane Society shall be advised. If no satisfactory alternative is found to abate such nuisance, such birds may be destroyed in such numbers and in such manner as is deemed advisable by such authorities under the supervision of the chief of police. 6.04.030 Penalty for violation of this chapter.

Any person, firm, partnership, or corporation who violates any part of this chapter shall be subject to the penalty and enforcement provisions in Chapter 1.12. (Ord. 2552-19 § 21, 2019)

6.04.040 Feeding of wild animals prohibited.

A.    Definitions.

1.    As used in this section, “feed” means to place any material to feed or attract wild animals.

2.    As used in this section, “wild animal” means any nondomesticated animal that lives in nature, including, but not limited to, turkeys, geese, and deer.

B.    No person shall place any material to feed or attract wild animals.

C.    This section shall not apply to wild birds other than geese and shall not prohibit the placement of grass, trees, and plants with roots in the ground on one’s property.

D.    The owner or occupant of the property shall have the duty to keep the property free of material that could provide food for wild animals. (Ord. 2608-20 § 1, 2020)
