17.66.005 Introduction.
The Moorland Road Area Planning Unit is depicted on a map available here and at the city clerk’s office and community development office. The following uses, standards and requirements apply to this district. (Ord. 2732-20 § 2, 2020)
17.66.010 Objectives.
A. Long-Term Value and Quality. By achieving uniformity in design expectations, the value of public and private investment can be sustained through the creation of a quality environment.
B. Design. To achieve a design aesthetic of urban form and character through guiding high-quality architecture and construction with attention to placement, relationship and orientation of structures to provide a greater sense of place. While most people will drive their autos to destinations in a new suburban development, greater opportunities for pedestrian access to sites will be created.
C. Compact Mixed Use. To create a compact concentration of multiple land uses including retail, retail service, entertainment, and office land uses that generate the critical mass necessary to achieve economic stability and vitality of the area. (Ord. 2732-20 § 2, 2020)
17.66.020 Permitted uses.
A. Any use permitted in the general business district except used car lots, fast food restaurants with drive-thru windows, casual dining restaurants with pick-up window; and any use permitted in the regional business district except that restaurants are not required to be located within a shopping center and may be free-standing without requiring a special exception. All permitted uses shall be subject to all approvals and conditions required by Chapter 17.100 and the provisions of this district.
B. General Regulations. All uses shall be conducted wholly inside a building or buildings as one integrated business operation except outdoor seating for a restaurant or tavern as approved under this district’s regulations. No storage of goods, materials, supplies, equipment, or stock-in-trade shall be permitted outdoors except the storing of living shrubs, trees, plants and flowers and items normally sold in the operation of a retail garden center which are not in bulk and not of a foul-smelling nature. The determination of such items normally sold shall be made by the plan commission. (Ord. 2732-20 § 2, 2020)
17.66.030 Building and parking locations.
A. Setback.
1. Building setback to public street: minimum 25 feet.
2. Pavement setback to public street: minimum 10 feet.
3. Zero feet setback for street yard accessory structures.
B. Offset.
1. Building offset: zero feet.
2. Pavement offset: minimum 10 feet.
C. Repealed by Ord. 2875-24.
D. Dumpsters.
1. Dumpster enclosure setback: minimum 25 feet.
2. Dumpster enclosure offset: minimum zero feet.
E. Building Placement. The location of a building shall create a sense of urban enclosure, such as a courtyard or a defined corridor, that enhances the relationship between door and window openings and other entries and the public or private street to strengthen the pedestrian experience. Buildings must be oriented toward the street with at least one major pedestrian entrance connected to the street/pedestrian way. No parking may be located in the area between the building and the street. A well defined pedestrian environment must be developed between the edge of the street and the street-side facade of the building. (Ord. 2875-24 §§ 15, 16, 2024; Ord. 2732-20 § 2, 2020)
17.66.040 Height restrictions.
A. Principal building: maximum thirty-five (35) feet.
B. Accessory buildings: fifteen (15) feet maximum. (Ord. 2732-20 § 2, 2020)
17.66.050 Area regulations.
A. Commercial building floor area ratio: maximum 0.4%.
B. Lot size.
1. Minimum area: thirty thousand (30,000) square feet.
2. Minimum average width: one hundred fifty (150) feet.
C. Landscape surface ratio (LSR): minimum fifteen (15) percent or the minimum area required to comply with Chapter 14, whichever is more restrictive.
D. Lot coverage: maximum ninety (90) percent or the minimum open space required to comply with Chapter 14, whichever is more restrictive. (Ord. 2021-061504 § 13, 2021; Ord. 2732-20 § 2, 2020)
