SEPTIC CLEANING

5.20.010 Purpose.
It is the purpose of the Town to control, regulate and supervise the removal from and disposal of sludge, waste, and other materials found in septic tanks in order to safeguard the health and welfare of the residents. (2008 code § 8.04(1))
5.20.020 Licensing.
Any person, firm, or corporation engaging in the business of cleaning or pumping septic tanks within the limits of the Town of East Troy shall obtain an annual license one year and shall begin on November 1st and end on October 31st of the following year. (2008 code § 8.04(2))
5.20.030 Application for licensing – Fee.
Applications for license shall be made to the Town Clerk on suitable forms furnished by him and on which said applicant specifically agrees to deposit said sludge, waste, or other materials removed from septic tanks at the site of the Town Dump and only at the site of the Town Dump until some other location shall be designated by the said Building Inspector. Said application shall also describe the equipment to be used by the applicant. An annual license fee of $100.00 shall be paid at the time of making application. (2008 code § 8.04(3))
5.20.040 Issuance of license.
The Town Clerk shall inspect the equipment of the applicant and if his equipment shall be found to be adequate and proper to undertake such work, and if it shall be found that the applicant is familiar with all rules and regulations of the Town of East Troy and the state of Wisconsin with reference to public health and sanitation, then the Building Inspector shall forthwith issue such license. 5.20.050 Appeals.
Should the Town Clerk fail or refuse to issue a license, the applicant may appeal to the Town Board of the Town of East Troy by filing a written request for a review of his application for license with the Town Clerk of the Town of East Troy within 10 days after such refusal, and said Town Board shall convene within 10 days after receipt of such notice of appeal and review said application. The applicant shall be given notice of the meeting of the Town Board for the review of said application and shall be permitted to attend in person or by counsel and present evidence in support of his application request. 5.20.060 License required before engaging in work.
No person, firm, or corporation shall engage in the business of cleaning or pumping septic tanks within the limits of the Town of East Troy without first obtaining the license therefor as herein provided before engaging in such work. (2008 code § 8.04(6))
5.20.070 License required for hiring.
No person, firm, or corporation shall engage and hire any person, firm, or corporation for the purpose of cleaning or pumping septic tanks located within the limits of the Town of East Troy who has not obtained the license to engage in such business in the Town of East Troy, and it shall be the duty of the person who engages or hires another to clean or pump his septic tank to first ascertain that such person to be hired or so engaged has a license from the Town of East Troy to do and perform such work. 5.20.080 Violation.
Each day that a violation of this chapter exists shall be deemed and constitute a separate offense. (2008 code § 8.04(8))
