DISPOSITION OF ROADSIDE GARBAGE

8.80.020 Garbage property of resident until pickup.
8.80.010 Intent.
It is the intent of this chapter to regulate garbage and refuse that is placed at the side of the road by residents intending to dispose of their garbage consistent with the Town of East Troy’s garbage pickup and disposal contract. This chapter is intended to:
1. Protect the property owner’s and the Town’s contract hauler’s legal rights to such garbage and refuse;
2. Prevent the theft of such property and protect the privacy rights of individuals; and
3. Preempt the scattering of garbage and integrity of the disposal process on public and private property. (2008 code § 11.14(1))
8.80.020 Garbage property of resident until pickup.
Garbage and refuse that is left at the roadside by property owners consistent with the Town’s pickup and disposal contract is the personal property of such resident until such time as the garbage and refuse is placed in vehicles operated by the Town’s contract hauler. It shall be deemed unlawful for a third party to rummage through, access, look through or take or remove any such garbage or refuse. (2008 code § 11.14(2))
8.80.030 Violation – Penalty.
Any person who violates this chapter shall be fined not less than $50.00 nor more than $500.00 for any incident involving accessing, rummaging through or incident relating thereto. Furthermore, the removal or taking possession of any item of garbage or refuse shall be subject to the same fine for each item and/or each container accessed by or interfered with by such third party.
