OFFENSES AGAINST PUBLIC PEACE

9.15.010 Disorderly conduct prohibited.

No person shall within the Town:

1.    In any public or private place engage in violent, abusive, indecent, profane, boisterous, unreasonably loud or other disorderly conduct which tends to cause or provoke an immediate disturbance of public order.

2.    Intentionally cause, provoke or engage in any fight, brawl, riot or noisy altercation other than a bona fide athletic contest.

3.    With intent to annoy another, make a telephone call whether or not conversation ensued. (2008 code § 9.05)

9.15.020 Loud and unnecessary noise prohibited.

No person shall make or cause to be made any loud, disturbing or unnecessary sounds or noise such as may tend to annoy or disturb another in or about any public place or park or any private residence. (Ord. 2024-5 § 1; 2008 code § 9.06)

9.15.030 Simple battery.

1.    Whoever causes bodily harm to another by an act done with intent to cause bodily harm to that person or another without the consent of the person so harmed in the Town of East Troy is guilty of a violation of this section and shall be penalized as provided in subsection (3) of this section.

2.    Definitions.

a.    “Bodily harm” means physical pain or injury, or any impairment of physical condition.

b.    “Intent” means the mental purpose to cause bodily harm to another human being, or a belief that the act, if successful, will cause such harm to another even if the defendant does not desire that harm to occur. It is not a defense for an actor who harms another to state that he or she did not believe bodily harm would occur if an ordinary person would know or should have known the harm would occur.

3.    Penalty. Any person who violates this section shall, upon conviction or upon an admission or a plea of no contest, be subject to a forfeiture of not more than $1,000. Said penalty is found in Wis. Stat. § 939.51(3)(b). The Town adopts and incorporates by reference in this section both Wis. Stat. §§ 939.51(3)(b) and 940.19(1).

4.    Any future amendments, revisions, or modifications of Wis. Stat. § 939.51(3)(b) or 940.19(1), adopted and incorporated herein, are intended to be made part of this section as such amendments, revisions, or modifications are made to said statutes. (Ord. 2019-5 §§ 1 – 4)
