16.050 Building Board of Appeals.
(1) Definition. There shall be a Building Board of Appeals of five members as follows: the City Engineer, who shall be chairman of the Board; the Chief of the Fire Department; and three citizens appointed by the Mayor and approved by the Common Council and who shall serve without compensation. The terms of office of the citizen members are hereby extended from April 30th until noon on June 1st of the years in which the respective terms expire. Each citizen member shall thereafter hold office for four years from noon on June 1st until noon on June 1st four years later. Whenever a vacancy occurs, a successor shall then be nominated by the Mayor as soon as practical and voted upon by the Council to complete the unexpired term. Said Board shall have full discretionary power and authority to affirm, modify, amend or reverse, in whole or in part, an order, ruling, requirement or decision of the Director of Building Inspection.
(2) Meetings – Secretary – Record. Meetings of the Board shall be held at the call of the chair and at such other times as the Board may determine, at a time and place it shall determine. The Director of Building Inspection shall be the secretary of the Board and shall keep a record of all its meetings, transactions and proceedings.
(3) Appeals – Requirements. Any person aggrieved by any order or ruling of the Director of Building Inspection may appeal from said order or ruling to the Building Board of Appeals, within five days after written notice of the order or ruling having been delivered to the person. The appeal shall be in writing, setting forth the order appealed, and shall be filed with the Director of Building Inspection, who shall send a notice thereof to each member of the Board at least five days before the scheduled meeting. Where a situation requires an immediate decision, that of the Director of Building Inspection shall be final and conclusive. Any appeal hereunder shall be accompanied by a filing fee of $100.00.
