29.010 Authority.

(1) The ordinance codified in this chapter is adopted by the City of Manitowoc (hereinafter referred to as the “City”) under the authority granted by Wis. Stat. § 62.234. This chapter, and any amendments thereto, supersedes all conflicting and contradictory soil erosion regulations previously enacted under Wis. Stat. §§ 62.234 and 62.23.

(2) The provisions of this chapter are deemed not to limit any other lawful regulatory powers of the City.

(3) The City hereby designates the Director of Public Works as the administering authority to administer and enforce the provisions of this chapter.

(4) The requirements of this chapter shall not preempt more stringent erosion and sediment control requirements that may be imposed by any of the following:

(a) Wisconsin Department of Natural Resources administrative rules, permits or approvals including those authorized under Wis. Stat. §§ 281.16 and 283.33.

(b) Targeted nonagricultural performance standards promulgated in rules by the Wisconsin Department of Natural Resources under Wis. Admin. Code NR 151.004.
