10.10.010 Officer’s action after arrest without warrant.
If a person is arrested without a warrant for the violation of a traffic regulation, the arresting officer shall issue a citation under Wis. Stats. Section 345.11 and, in addition:
(a) May release the person; or
(b) Shall release the person when he:
(1) Makes a deposit under Wis. Stats. Section 345.26.
(2) Deposits the person’s valid state operator’s license with the officer. If the license is deposited with the officer, the officer shall issue to the licensee a receipt which shall be valid as a driver’s license through the date specified on the receipt, which shall be the same as the court appearance date, and the officer shall, at the earliest possible time prior to the court appearance date, deposit the license with the court.
(3) Presents a guaranteed arrest bond certificate under Wis. Stats. Section 345.61.
(c) Shall, if the alleged violator is not released under subsection (a) or (b) of this section, bring him without unreasonable delay before the municipal judge.
(d) Shall, if the alleged violator is released under subsection (a) or (b) of this section, specify on the citation a return date which may not be more than 90 days after the issue date. [Code 2002 § 50-31.]
10.10.020 Forfeitures.
The law enforcement officer or town police officer or the court shall deliver forfeited penalties to the town treasurer upon order of the county court and within seven days after the court issues the order. [Code 2002 § 50-32.]
10.10.030 Bonds.
Nothing in this chapter shall be construed to limit the right of proper authorities to accept bail bonds, deposits, certificates or money deposits, or permit a person’s release from custody on his own bond, as provided in Wis. Stats. Section 66.114. [Code 2002 § 50-33.]
