18.36.010 Purpose.

The purpose of the AC-10 commercial agriculture district is to encourage agricultural development through the maximum cultivation and reclamation of lands by restricting incompatible uses within such areas. It is also the purpose to preserve and encourage existing and future agricultural land uses as viable, permanent land uses, and as a significant economic activity within the community. Douglas County recognizes and acknowledges the importance of agricultural lands and activities to its livelihood. 18.36.020 Permitted uses.

The following uses are permitted outright in the AC-10 district:

A.     Agricultural uses such as the cultivation of fruit and nut trees, grape vines, row crop production or other horticultural stock, nonretail greenhouses and nurseries, and the keeping of livestock and poultry, subject to DCC Chapter 18.16;

B.     Agriculturally related industry;

C.     Aquaculture;

D.     Single-family dwelling;

E.     Duplex dwelling, subject to the density provisions established in DCC Section 18.36.080;

F.     Agricultural support activities for Ag-to-Ag transfers, family farm support divisions, and limited lot segregations pursuant to DCC Chapter 18.16 and the density provisions set forth in DCC Section 18.36.080;

G.    Structures for the storage of personal property, such as private garages and carport structures, equipment buildings or storage sheds, not intended for human habitation as living quarters;

H.     Bed and breakfast operations with three or fewer rooms;

I.     Riding stables, horse boarding/training facilities;

J.     Clustering of existing lots in accordance with DCC Section 18.16.044;

K.    Cluster divisions in accordance with DCC Section 18.16.046;

L.    Short-term inert waste storage/treatment piles;

M.    Utility distribution/transmission facility in accordance with DCC Section 18.16.320;

N.    Grain storage (commercial elevator);

O.    Agricultural market, in conformance with the standards of DCC Section 18.80.300 and on a parcel located adjacent to a state highway; and

18.36.030 Accessory uses.

The following are considered accessory uses to the permitted uses:

A.     In-home day care;

B.     Home fruit stands in accordance with DCC Chapter 18.16;

C.    Accessory structures for the storage of personal property, such as private garages and carport structures, equipment buildings or storage sheds, not intended for human habitation as living quarters;

D.    Accessory structures for the keeping and raising of livestock/poultry and general farming including barns, shops, and shelters, provided the agricultural products are produced on site or on other lands owned/controlled by the land owner/operator;

E.     Agritainment activities;

F.     Agricultural accessory housing for workers employed in the owner’s operation, in accordance with DCC Chapter 18.16; and

18.36.040 Conditional uses.

Those uses designated in the conditional use permit matrix as conditional uses and approved pursuant to DCC Chapter 18.80; provided, that the development standards of this chapter are met. (Ord. TLS 03-01-01B Exh. B (part): Ord. TLS 97-10-71B Exh. F (part))

18.36.050 Prohibited uses.

The following are prohibited uses in the AC-10 district:

A.    Accumulation of junk materials;

B.    Advertising displays or structures;

C.    Signs, except as provided in DCC Chapters 18.80 and 20.44;

D.    Vehicle, equipment, implement, and/or general repair not authorized pursuant to DCC Section 18.78.050;

E.    Appliance repair;

18.36.060 Development standards.

Development in the AC-10 district shall meet all of the applicable provisions of the DCC and the following requirements:

A.    Minimum required yards and setbacks shall be those established in DCC Chapter 18.16, except buildings, structures, parking, storage areas and all support activities associated with packing houses, warehouses, refrigerated storage, related shop buildings and/or home storage facilities shall be set back one hundred feet from any side or rear property line when adjacent to an off-premises agricultural or residential use;

B.    Lot size: Ten acres, or one sixty-fourth of a section minimum, including that area to the centerline of public rights-of-way, except for lots created under the provisions of DCC Sections 18.16.044, 18.16.046 and 18.16.220;

C.    Lot width: One hundred sixty-five feet minimum, except for lots created under the provisions of DCC Sections 18.16.044, 18.16.046 and 18.16.220. These lots shall have a minimum width of seventy feet;

D.    Lot coverage: Maximum lot coverage of buildings and structures shall be calculated at the rate of thirty-five percent for the first one acre of the lot and twenty percent for the remainder of the lot area, except agriculturally related industries shall be determined by compliance with all applicable provisions of county code, including without limitation landscaping, parking, stormwater, setbacks, and building/fire and life safety requirements;

E.    Building height: Thirty-five feet maximum height for all nonagricultural buildings and structures and forty feet for agricultural buildings and structures;

F.    Packing houses, warehouses, refrigerated storage and similar activities located on a state highway or arterial road shall address the requirements of DCC Section 18.16.210 in the project design and operation phases. Only one access point to the state highway or to the arterial road shall be allowed unless otherwise authorized by the WSDOT or the county engineer as appropriate. The access location and improvements shall be made in accordance with the specifications of the WSDOT or the county engineer as appropriate;

G.    Development standards: Landscaping, off-street parking and loading, road improvements and stormwater drainage shall be provided in accordance with DCC Title 20. (Ord. TLS 13-12-40B Exh. B (part); Res. TLS 04-39 Att. (part): Ord. TLS 03-01-01B Exh. B (part): Ord. TLS 97-10-71B Exh. F (part))

18.36.070 Performance standards.

A.    Resource disclosure statements shall be required when applicable in accordance with DCC Chapter 18.16.

B.    Cluster developments located adjacent to urban growth areas or RSC districts shall be designed to allow efficient conversion of the reserve tracts not designated as critical areas in order to allow future uses. The arrangement of clustered building lots shall allow access to the reserve tract and provide for the logical extension of public roads and facilities. (Ord. TLS 11-06-33B Exh. B (part): Ord. 18.36.080 Density.

The maximum density in the AC-10 district shall be one dwelling unit per ten acres, except as provided in DCC Chapter 18.16 for accessory dwelling units and lots created under the provisions of DCC Section 18.16.220, Agricultural support.
