2.20.010  Selection.

The executive power of the borough is vested in the borough manager, who shall be selected on the basis of merit and fitness, to serve at the pleasure of the assembly.  (Ord. 2013-08 §1 (part), 2013:  Ord. 76-18 §8(part), 1976:  Ord. 2 §12(a)(part), 1963).

2.20.020  Powers--Administrative duties.

The manager has and shall have all of the powers and duties set forth in the Alaska Statute presently numbered AS 29.20.500, other powers and duties elsewhere prescribed by law, and as set forth in this code.  Except as otherwise provided by law or ordinance, the manager has the supervision and control, directly and indirectly, over all administrative departments, agencies, directors, and all other employees of the borough.  The manager may introduce ordinances, and has no veto power, but he shall be the chief administrative officer of the borough.  The manager is responsible for the proper administration of all borough affairs placed in his charge by law and ordinance, and shall:

A.    Except as otherwise specifically provided by law or ordinance, appoint all borough employees and the heads of each borough department and suspend or remove any borough employee or the head of each department;

B.    See that all ordinances, resolutions, and orders of the assembly, and all laws of the state subject to enforcement by him, or by officers who are subject under this title to his direction and supervision, are faithfully executed;

C.    Prepare and submit the annual budget and capital program to the assembly, and execute the budget and capital program in accordance with appropriations and ordinance adopted by the assembly;

D.    Examine regularly the accounts, records, and operation of every borough department; make regular monthly reports to the assembly on borough affairs; keep the assembly fully advised on the financial condition and future needs of the borough; and make such recommendations on borough affairs as he deems desirable;

E.    Submit to the assembly at the end of the fiscal year a complete report on the finances and administrative activities of the borough for the preceding year, and prepare and make available for distribution to the public, within three months after the end of each fiscal year, an annual report on borough affairs during that fiscal year;

F.    If the assembly provided for a personnel system, serve as the personnel officer of the borough and administer the borough personnel system, unless the assembly authorizes the appointment of a personnel officer to administer the system;

G.    Carry into execution such other powers and duties as are required by law or may be prescribed by the assembly; and

H.    Hire such administrative assistance as he deems necessary to help him in the administration of borough affairs.  (Ord. 2015-11 §6, 2015:  Ord. 2013-08 §1 (part), 2013:  Ord. 2005-07, 2005; Ord. 76-18 §8 (part), 1976:  Ord. 2 §12(a) (part), 1963).

2.20.030  Supervisory duties.

The borough manager shall direct and supervise the administration of the following functions:

A.    The functions of all borough officers and employees, except as provided otherwise;

B.    The care and custody of all borough buildings, and of all borough real and personal property;

C.    The construction, maintenance, and operation of borough roads, bridges, drains, buildings, and other public works, insofar as such items are owned or controlled by the borough.  (Ord. 2013-08 §1 (part), 2013:  Ord. 76-18 §8 (part), 1976:  Ord. 2 §12(b), 1963).

2.20.040  Departments--Distribution of activities--Administration.

The activities under the direction and supervision of the borough manager shall be distributed among such departments as are established by law or ordinance.  Each department shall be administered by an officer appointed by, and subject under this title to the direction and supervision of, the borough manager unless otherwise provided by law.  The head officers of all borough departments shall serve at the pleasure of the borough manager.

With the consent of the assembly, the manager may serve as the head of one or more departments.  (Ord. 2015-11 §7, 2015:  Ord. 2013-08 §1 (part), 2013:  Ord. 76-18 §8 (part), 1976: Ord. 2(c), 1963).

2.20.050  Rights in assembly.

The borough manager shall have the right to take part in the discussion of all matters coming before the assembly, but may not vote.  (Ord. 2013-08 §1 (part), 2013:  Ord. 76-18 §8 (part), 1976: Ord. 2 §12 (d), 1963).

2.20.060  Officers--Appointment and promotion criteria--Personnel system.

A.  All appointments and promotions of borough officers and employees shall be made on the basis of merit and fitness, and the assembly may provide for a personnel system.

B.    Unless otherwise provided by ordinance, the borough clerk, borough attorney, borough treasurer, and borough police chief are appointed by the borough manager.  Unless otherwise provided by ordinance, an official described in this section serves at the pleasure of the appointing authority and, if appointed by the borough manager, must be confirmed or not confirmed by the assembly.  (Ord. 2013-08 §1 (part), 2013:  Ord. 76-18 §8 (part), 1976: Ord. 2 §12(e), 1963).

2.20.080  Officers--Bond required.

The borough manager and such other borough officers or employees as the assembly may provide shall give reasonable bond in the amount and with the surety prescribed by the assembly.  The premium on such bonds shall be paid by the borough.  (Ord. 2013-08 §1 (part), 2013:  Ord. 76-18 §8(part), 1976: Ord. 2 §12(g), 1963).
