OBSTRUCTING STREETS AND SIDEWALKS

9.56.010 Trees and shrubbery to be trimmed.

The owner of any premises abutting on any street of the city shall trim all trees and shrubbery growing in the parkway, between the sidewalks and the roadway, of any such street, and all trees and shrubbery growing on any part of the premises adjacent to the sidewalks or any street or alley, in such manner that the boughs or limbs thereof shall not obstruct free and convenient passage and travel along the streets, sidewalks, and alleys. When such premises are occupied by some person other than the owner, such occupant shall trim the trees and shrubbery in the same manner as hereinbefore required of the owner. Such trees and shrubbery shall be trimmed so that the lowest branches or foliage shall not be lower than 10 feet above the roadway of a street or alley, nor lower than eight feet above the sidewalk. 9.56.020 Violation of KMC 9.56.010.

Any owner or occupant who fails, refuses, or neglects to trim trees and shrubbery as provided in KMC 9.56.010, after receiving at least five days’ notice from the city engineer to do so, shall be guilty of a misdemeanor. Every day that the owner or occupant fails, refuses, or neglects to trim the trees or shrubbery after the expiration of the notice shall be a separate offense. (Code 1962 § 18-2)

9.56.030 Injury to trees and shrubbery.

It is unlawful for any person to injure any tree or shrubbery on a street, alley, or other public area in the city; provided, that this shall not prohibit the lawful and proper care and removal of such trees and shrubbery. (Code 1962 § 18-3)

9.56.040 Obstructing public ways.

It is unlawful for any person, firm or corporation to place upon or permit to be placed upon the sidewalks, parkways, streets or alleys of the city any goods, wares, articles of merchandise or any other obstruction, and leave the same thereon, or to use the same as a place to carry on a business or trade. The provisions of this section, KMC 9.56.050 and 9.56.055 shall not apply on a street or sidewalk which has been closed by order of the city manager for the purpose of a special event, festival or street sale when the city manager has issued a permit authorizing the sale, display and placement of such goods, wares, articles or obstructions. Any such permit shall describe the location of each obstruction which shall not exceed five days and such other conditions as the city manager may determine including but not limited to requirements for insurance and performance bonds. 9.56.050 Interference with traffic by obstructing way.

It is unlawful for any person, firm, or corporation to use or obstruct the sidewalks of the city in any manner so as to interfere unduly with pedestrian traffic thereon, or to use or obstruct the streets and alleys of the city in any manner so as to interfere unduly with lawful traffic and parking thereon. 9.56.055 Vending on sidewalks from private property.

No person may sell or offer to sell goods or services from private property abutting a public sidewalk in a manner which causes or is likely to cause customers to stand on the public sidewalk while ordering, making the purchase, or waiting to be served unless there is sufficient unobstructed sidewalk space between the cart, structure or building from which the sale takes place and the face of the curb or edge of the sidewalk if there is no curb to allow the free and unobstructed passage of pedestrians. 9.56.060 Depositing refuse on streets or sidewalks.

It is unlawful for any person, firm, or corporation to deposit, throw, or sweep into or upon the streets, alleys, parking, or sidewalks of the city any paper, rubbish, grass, weeds, tree trimmings, dirt, trash, crates, boxes, or other refuse of any kind. (Code 1962 § 18-6)

9.56.070 Playing on streets or sidewalks.

It is unlawful for any person to play on the sidewalks or upon the main traveled portion of the streets and alleys of the city, except as may be authorized by ordinance. (Code 1962 § 18-7)

9.56.080 Washing vehicle.

It is unlawful for the owner, agent or employee of any automobile dealership, garage, filling station, car wash or any other commercial provider of automotive services, while in the course of business, to wash a vehicle which is parked in or upon any street, highway, roadway, alley or other vehicular way within the city. 9.56.090 Drainage from business.

It is unlawful for any owner or operator of a filling station or other place of business, or any agent or employee thereof, to cause or allow water, grease, or other fluid to flow or drain into, upon, over, or across any sidewalk, parking, street, alley, or other public way. (Code 1962 § 18-9)

9.56.100 Hazardous sidewalk area.

It is unlawful for the owner or occupant of property abutting upon a sidewalk or sidewalk area to permit the sidewalk or sidewalk area adjacent to the property to become a hazard to persons using the sidewalk or sidewalk area. (Code 1962 § 18-10)

9.56.110 Snow or ice accumulating on sidewalk.

It is unlawful for the owner or the occupant of any premises abutting on any sidewalk in the city to allow to accumulate on such walk snow or ice rendering the same dangerous or inconvenient for pedestrians. (Code 1962 § 18-11)

9.56.120 Clearing sidewalk of snow or ice.

It is hereby made the duty of the owner or occupant of any premises abutting on any sidewalk in the city to clear the walk of snow and ice accumulating thereon before 12:00 noon of each day. (Code 1962 § 18-12)
