19.06.010 Permit for excavation or work in street right-of-way required.
It shall be a violation for any person to make, cause to be made, or to permit any: excavation; rerouting of pedestrian or vehicular traffic; erection of scaffolding; connection to sewer, water, storm drains, or other utility facilities; removal and/or replacement of curbs, paving or sidewalks; placement of fill; operation of track-mounted equipment; placement of cranes or derrick devices; or other obstruction or construction in a street right-of-way without first obtaining a permit as authorized in KMC 2.24.020(g).
19.06.020 Exemptions.
KMC 19.06.010 shall not apply to municipal utility work on overhead lines, and shall not apply to emergency municipal utility repairs to underground water, power or communications systems; provided, however, that the city’s public works department is immediately notified of such emergency repairs. The city’s public works department shall immediately notify the municipal utility of emergency repair work to sewers or storm drain lines. KMC 19.06.010 shall not apply to work performed by or under the direction of the city’s public works department and shall not apply to emergency work done by or at the direction of fire, police or emergency government.
19.06.030 Penalty.
Any person who violates any provision of this chapter, or performs any unlawful act as defined in this chapter, or fails to perform any act required by this chapter, shall be punished by a fine not to exceed $300.00. (Ord. 1254 § 1, 1993)
