2.25.010 Creation, election and term.
The Nome school district shall be coextensive with the corporate limits of the city, and shall be governed by the Nome school board consisting of five members elected at large at the regular election for three-year terms and until their successors take office. (Ord. O-93-6-6 § 1 (part), 1994)
2.25.020 Qualifications of members.
Any person qualified to vote in the city and who is not delinquent in payment of any undisputed city property tax, sales tax, utility bill or other financial obligation is eligible to be a member of the school board. (Ord. O-13-06-07 § 12, 2013: Ord. O-93-6-6 § 1 (part), 1994)
2.25.030 Officers.
Within seven days after the certification of the results of each regular school election, the school board shall meet and elect one of its members as president, one as clerk, and one as treasurer. (Ord. O-93-6-6 § 1 (part), 1994)
2.25.040 Vacancy in office.
When a member of a school board has notice of and is absent from three consecutive regular school board meetings and is not excused by the president of the school board or is delinquent in payment of any undisputed city sales tax, property tax, utility bill or other financial obligation and fails to cure said delinquency within thirty days after receipt of written notice of an intent to declare the seat vacant signed by the president of the school board, the other members of the school board may declare the position vacant and shall notify the ex-member by registered mail. 2.25.050 Filling a vacancy.
If a vacancy occurs on the school board, the remaining members shall within thirty days fill the vacancy. The person selected shall serve until the next regular election when a successor shall be elected to serve the balance of the term. (Ord. O-93-6-6 § 1 (part), 1994)
2.25.060 Centralized treasury and accounting.
(a) The city council may by ordinance require that all school money be deposited in a centralized treasury with all other city money. The city administration shall have the custody of, invest and manage all money in the centralized treasury. However, the city council, with the consent of the school board, may by ordinance delegate to the city school board the responsibility of a centralized treasury.
(b) If the school board by resolution consents, the city council may by ordinance provide a centralized accounting system for school and all other city operations. The system shall be operated in accordance with accepted principles of governmental accounting. However, the council, with the consent of the school board, may by ordinance delegate to the school board the responsibilities of the accounting system. (Ord. O-93-6-6 § 1 (part), 1994)
2.25.070 School budget approval.
(a) The school board shall submit the school budget for the following school year to the city council by May 1st for approval of the total amount.
(b) By May 31st the city council shall determine the total amount of money to be made available from local sources for school purposes and shall furnish the school board with a statement of the sum to be made available.
(c) If the city council does not, by May 31st, furnish the school board with a statement of the sum to be made available, the amount requested in the budget is automatically approved.
(d) By May 31st, the city council shall appropriate the amount to be made available from local sources from money available for the purpose. (Ord. O-18-07-03 § 2, 2018: amended during 3/99 supplement; Ord. O-93-6-6 § 1 (part), 1994)
2.25.080 Report of expenditures to council.
The school board shall, when required by the city council, but not more often than once each month, transmit to the city council a detailed report and statement of money expended and for what and to whom the money was paid. (Ord. O-93-6-6 § 1 (part), 1994)
2.25.090 Records and accounts.
(a) The clerk of the school board shall keep the minutes of the meetings and a record of all the proceedings of the board in permanent form.
(b) The treasurer of the school board shall keep an accurate and full account of all the money received and expended by the school district and shall preserve the proper vouchers for all expenditures. (Ord. O-93-6-6 § 1 (part), 1994)
2.25.100 School sites and design.
(a) The city council shall determine the location of school buildings with due consideration to the recommendations of the city school board.
(b) The school board is responsible for the design criteria of school buildings. The city council is responsible for approval of the final design of school buildings.
(1) Subject to the approval of the city council, the school board shall select the appropriate professional personnel to develop the designs.
(2) To the maximum extent consistent with education needs, a design of a school building shall provide for multiple use of the building for community purposes.
(3) The school board shall submit preliminary and subsequent designs for a school building to the city council for approval or disapproval; if the design is approved, a revised design shall be prepared and presented to the city council.
(c) A design or revised design approved by the city council shall be submitted by the school board to the department of education. (Ord. O-93-6-6 § 1 (part), 1994)
2.25.110 School maintenance and repair.
(a) The school board shall provide custodial services and routine maintenance for school buildings and shall appoint, compensate, and otherwise control personnel for these purposes.
(b) The city council, through the city manager, shall provide for all major rehabilitation, all construction and major repair of school buildings. The recommendations of the school board shall be considered in carrying out the provisions of this section. (Ord. O-93-6-6 § 1 (part), 1994)
2.25.120 School administration and purchasing.
(a) State law relating to teacher salaries and tenure, to financial support, to supervision by the department of education and other general laws relating to schools, governs the exercise of the functions by the city.
(b) The school board shall appoint, compensate, and otherwise control all school employees and administration officers in accordance with Alaska law.
(c) The school board may determine its own policy separate from the city for the purchase of supplies and equipment. (Ord. O-93-6-6 § 1 (part), 1994)
2.25.130 Open records.
(a) All records and files of the school board shall be open to inspection by the public at the principal administrative office of the district during reasonable business hours, except personnel records, student files, records pertaining to pending litigation, and other records required by law to remain confidential or restricted.
(b) Any employee who violates this section shall reimburse the city for any loss it suffers as a result of the violation. (Ord. O-93-6-6 § 1 (part), 1994)
2.25.140 Public participation.
All regular and special meetings of the school board shall be open to the public, except as otherwise provided for executive sessions in Alaska Statutes. The school board shall provide the public with a reasonable opportunity to be heard at each regular or special meeting. (Ord. O-01-6-7 § 3, 2001)
