2.04.010 Duties generally.

The mayor shall preside at council meetings, act as a ceremonial head of the city, sign documents on the city’s behalf upon council authorization, be the chief administrative officer and act as the personnel officer. 2.04.020 Qualification – Term.

A. Any voter in the city who has been a resident of the city for three years immediately preceding the election is eligible to hold the office of the mayor.

B. The mayor is elected at large for a term of three years and until a successor is elected and has qualified. A person who has served as mayor for two consecutive terms may not be reelected to that office until one full year has intervened.

C. The mayor’s regular term begins on the first Monday following certification of the mayor’s election. (Ord. 2002-01 §2; Ord. 88-7 §3(part): Ord. 83-11 §3(part): prior code §2.02.020)

2.04.030 Vacancies.

A. The office of the mayor shall be deemed vacant upon occurrence of any of the criteria listed in Section 2.08.070.

B. A vacancy in the office of the mayor occurring within one hundred eighty days of a regular election shall be filled by the council. The person designated shall serve until the next general election and until a successor is elected and has qualified. If a council member is chosen he shall resign his council seat. If a vacancy occurs more than one hundred eighty days before a regular election the council shall call a special election to fill the unexpired term. 2.04.040 Vote in council.

The mayor is not a council member but may only vote in the case of a tie. (Ord. 88-7 §3(part): Ord. 83-11 §3(part): prior code §2.02.035)

2.04.050 Veto.

The mayor may veto any ordinance, resolution or motion, or other action of the council, and may by veto strike or reduce items in appropriation ordinances. If the mayor exercises his veto he must submit to the council at its next regular meeting a written statement advising of veto and giving his reasons. A veto may be overridden by the vote of two-thirds of the authorized membership of the council. (Ord. 88-7 §3(part): Ord. 83-11 §3(part): prior code §2.02.040)

2.04.055 Temporary absence, illness or disability.

A. During any temporary absence from the city or temporary illness or disability of the mayor, the mayor pro tempore appointed by the mayor under Section 2.08.055 shall preside at council meetings, act as a ceremonial head of the city, sign documents on the city’s behalf upon council authorization and shall assume all other duties and powers of the mayor under Sections 2.04.040, 2.04.050 and 2.08.040.

B. The mayor pro tempore shall file a written statement with the city clerk, reciting the reasons for exercising those powers and duties; the city clerk shall note thereon when the mayor returns or resumes his duties.

C. During any temporary absence from the city or temporary illness or disability of the mayor, the acting chief administrative officer appointed by the mayor under Section 2.16.080 shall assume all of the duties of the chief administrative officer under Section 2.16.040. 2.04.060 Compensation.

The mayor shall receive such compensation as the city council may determine. In determining the mayor’s compensation, the council shall provide that the mayor shall not receive any compensation for any period beginning after three working days without notifying the mayor pro tempore of the reason for such failure and ending with the working day prior to the day on which the mayor next attends to city business.
