TOWN MANAGER

2.05.090 Council to act through manager.
2.05.010 Appointment.
The town manager shall be appointed by the council on the basis of executive and administrative qualifications with special reference to actual experience in or knowledge of accepted practice in respect to the duties of office as hereinafter set forth; and shall hold office for and at the pleasure of the council. 2.05.020 Eligibility.
Residence in the town at the time of appointment shall not be required as a condition of the appointment. [Ord. 66 § 3, 2002. Code 1983 § 3-2-6(B).]
2.05.030 Removal.
The town manager may be removed by the affirmative vote of four members of the town council at a regular or special council meeting. [Ord. 66 § 3, 2002. Code 1983 § 3-2-6(C).]
2.05.040 Resignation.
The town manager shall give at least a 30-day written notice of his/her intention to resign before leaving office. Failure on the part of the town manager to give said written notice shall relieve the town of any responsibility of paying any salary to the town manager for the 30-day period immediately preceding resignation. 2.05.050 Compensation.
The town manager shall receive such compensation as the council shall from time to time determine, and said compensation shall be a proper charge against such funds of the town, as the council shall designate. The town manager shall be reimbursed for all sums necessarily incurred or paid in the performance of duties, or incurred when traveling on business pertaining to the town. [Ord. 66 § 3, 2002. 2.05.060 Powers and duties.
The town manager shall be the administrative officer of the town government and shall be responsible to the council for the proper administration of all affairs of the town under the specific direction and control of the council. (Nothing herein is intended to diminish the powers of the mayor set forth in TTC 2.10.070 through 2.10.130.) In addition to the general powers as the chief administrative officer and not as limitation thereon, it shall be the town manager’s responsibility and authority:
A. To see that all laws and ordinances of the town are enforced, and that all franchises and privileges granted by the town are faithfully observed.
B. To appoint and, when deemed necessary for the good of the town, to layoff, suspend, transfer, demote or remove department heads and employees of the town.
C. To supervise and give directions to all heads of departments, subordinate officers and employees of the town except elected or judicial officers and their respective staffs.
D. To attend all meetings of the council (unless excused therefrom) with the duty of reporting on or discussing any matter concerning the affairs of the departments, boards, services, or activities under the town manager’s supervision upon which the council should be informed and to attend, or designate a representative to attend, all board and commission meetings.
E. To recommend to the council for adoption such measures and ordinances as are deemed beneficial for the town.
F. To recommend to the council, at periodic intervals, changes needed in the town code.
G. To keep the council at all times fully advised as to the financial condition and needs of the town.
H. To prepare the town budget annually and submit it to the town council, together with a message describing the important features contained therein, and to be responsible for its administration after adoption.
I. To prepare and submit to the town council at the end of each fiscal year a complete report on the finances of the town during the preceding year.
J. To supervise the expenditures of all departments, divisions or services of the town and to act as a purchasing agent for the purchase of all supplies, goods, wares, merchandise, equipment and material which may be required for any such departments, divisions or services.
K. To analyze the functions, duties, and activities of various departments, boards and services of the town government and for all employees thereof, and to make such recommendations to the council as in his/her judgment will, if made effective, result in the highest degree of efficiency in the overall operation of the town government.
L. To investigate all complaints in relation to the administration of the town, its utilities or enterprises.
M. To exercise general supervision over all public buildings, public parks and other public property which are under the control and jurisdiction of the council.
N. To devote as much time as necessary to the duties of the office of town manager and the interest of the town.
O. To perform such other duties and exercise such other powers as may be delegated to the town manager from time to time by ordinance or resolution of the council. [Ord. 66 § 3, 2002. Code 1983 § 3-2-6(F).]
2.05.070 Policy making.
The town manager shall not exercise any legislative function, nor shall he/she engage in policy making. The town manager shall implement policy made by the council. [Ord. 66 § 3, 2002. Code 1983 § 3-2-6(J).]
2.05.080 Public relations.
In the discharge of his/her duties, the town manager shall endeavor at all times to exercise the highest degree of tact, patience and courtesy in contacts with the public and with all town commissions, departments and employees and shall use his/her best efforts to establish and maintain a harmonious relationship between all personnel employed by the government of the town to the end that the highest possible standards of public service shall be continuously maintained. 2.05.090 Council to act through manager.
Except for the purpose of inquiry, the council and its members shall deal with the administrative branch of the town governmental organization solely through the town manager. Neither the council nor any member thereof shall give orders directly to any subordinate of the town manager publicly or privately. It shall be the responsibility of the council to aid and assist any appointive officer or any department head in an advisory capacity, but such assistance shall not conflict with the administrative duties of the town manager. In the event that the town manager considers hiring, demotion or dismissal of appointive officers or department heads (as defined under state statute and this code), the town manager shall make a recommendation to the council, and the hiring, demotion or dismissal shall be subject to the approval of the council as stated in TTC 2.15.010.
