6.22.010 Excessive Animal Noise
A. No person shall keep an animal within the City limits which emits noise that (1) is intermittent or continuous for a period of at least fifteen (15) minutes in duration and disturbs the peace and order of a neighbor or (2) that occurs after ten p.m. and before six a.m. and disturbs the peace and order of a neighbor.
B. As used in this section, the phrase "noise" shall mean and include barking, howling, or any other noises which disturb the peace of any person of ordinary sensibilities residing in the City. The term "neighbor" shall mean an individual residing in a residence or structure, or conducting business in a building, which is within one hundred (100) yards of the property on which the animal is kept or harbored.
C. A person who violates this section shall be responsible for a civil infraction punishable by a fine of not less than one hundred dollars ($100.00) nor more than two hundred fifty dollars ($250.00) for each violation. Each day of any violation of this section is considered a separate violation.
D. After having been found responsible for committing two (2) or more violations of this section, a person may be charged with a Class 3 misdemeanor punishable in accordance with law.
E. The owner or custodian of animal(s) may only be charged with a violation of this section when the animal control or law enforcement officer has witnessed the commission of a violation of this section or has received either: (1) sworn affidavits attesting to the commission of a violation of this section from at least two (2) neighbors, or (2) a sworn affidavit attesting to the commission of a violation of this section from at least one (1) neighbor and a recorded video showing the alleged violation.
F. This section shall not apply to animals maintained on land zoned for agricultural purposes, nor shall it apply to a properly permitted animal shelter established for the care and/or placement of unwanted or stray animals, nor a properly zoned commercial boarding kennel or other animal facility that may be approved by the City in accordance with law.
