9.68.010 Definitions and rules of construction.
The following words and phrases, when used in this chapter, shall be construed to have the following meaning:
A. "In the county" means and includes all territory over which the county now has, or shall hereafter acquire jurisdiction for the execution of its policy powers or other regulatory powers.
B. Official time. Whenever certain hours are named herein, they shall be construed to mean Pacific Standard Time or Daylight Saving Time, whichever may be in current use in the county.
C. "Social function" means any formal or informal party or assemblage of two or more persons not in violation of any law or injurious to the health or well being of the participants, designed to promote the pleasure and welfare of the participants. (Ord. 294 §1, 1958).
9.68.020 Established--Exceptions.
It is unlawful for any minor under the age of eighteen years to loiter or to be upon any street, road, highway, private road or the land of any person without his written consent, or in any place open to the public in the county between the hours of tenthirty p.m. and six a.m.; however, provided, that a minor under the age of eighteen years may be upon the streets, roads or highways or in any place open to the public in the county between the hours of ten-thirty p.m. and six a.m., under any of the following conditions:
A. When such minor is in the company of his parent or legal guardian or person having the legal care, custody and control of such minor;
B. When such minor is in the act of returning to the home of his parent, legal guardian or person having the legal care, custody and control of such minor, from any licensed moving picture theatre or any social or religious function or from social or athletic functions connected with, sponsored and sanctioned by whatever educational institution said minor may be attending. 9.68.030 Responsibility of associates.
It is unlawful for any person to associate or meet with, or be in the company of any minor under eighteen years of age when such minor is upon any street, road, highway, private road or the land of any person without the owner's written consent, or in any place open to the public in the county between the hours of ten-thirty p.m. and six a.m., in violation of the provisions of Section 9.68.020. (Ord. 294 §4, 1958).
9.68.040 Curfew--Places of business.
It is unlawful for the owner of any place open to the public in the county,. or his manager, agent or employee, to suffer or permit any minor under the age of eighteen years to be in such place of business between the hours of ten-thirty p.m. and six a.m. in violation of any provision of this chapter. (Ord. 294 §5, 1958).
9.68.050 Violation--Penalty.
A. Any minor under the age of eighteen years who violates any of the provisions of this chapter shall be cited by any peace officer of the county to appear upon a date specified before the probation officer of Amador County to be dealt with according to law.
B. Any person of the age of eighteen years or more who violates any of the provisions of this chapter is guilty of a misdemeanor and is punishable by a fine not exceeding one hundred dollars or by imprisonment in the county jail for a period not exceeding thirty days, or by both such fine and imprisonment.
