CHAPTER 7—UNCLAIMED PROPERTY IN THE POSSESSION OF THE POLICE DEPARTMENT

Sec. 2800 Unclaimed Property.

All property which comes into the possession of the Arcata Police Department shall be cared for and disposed of in accordance with the provisions of this chapter, unless specific provision for the care and disposal of the particular property is elsewhere made by law.

Sec. 2801 Unclaimed bicycles.

Unclaimed bicycles shall be held by the Arcata Police Department for a period of at least three (3) months from the date they first come into the possession of the Arcata Police Department, after which period they may be disposed of as set forth in this chapter.

Sec. 2802 Other property.

All other unclaimed property, other than unclaimed bicycles, shall be held by the Arcata Police Department for a period of at least four (4) months from the date it first comes into the possession of the Arcata Police Department, after which period it may be disposed of as set forth in this chapter.

Sec. 2803 Auction.

When unclaimed property has been in the possession of the Arcata Police Department for the periods mentioned in Sections 2801 and 2802 of this chapter, it shall thereafter be sold at public auction, without reserve, to the highest bidder. If no bid is received on an article of unclaimed property, the Chief of Police may, at his discretion, either retain the property for sale at the next public auction held pursuant to this chapter, or he may have the property destroyed in an appropriate manner.

Sec. 2804 Notice of auction.

Notice of public auction sales of unclaimed property shall be given by the Chief of Police by having a Notice of Sale published once, at least 5 days before the time set for the proposed sale, in one or more newspapers of general circulation published in Humboldt County. Notice of such sale may also, in addition to such publication, be given by other appropriate means.

Sec. 2805 Contents of notice.

The published Notice of Sale shall state the date and hour of the proposed sale, the place of the proposed sale, the fact that the auction shall be without reserve, and it shall contain a brief description of the articles to be sold.

Sec. 2806 Retention of property.

If the City Council determines that any such property is needed for a public use, such property may be retained by the City and need not be sold.
