SHOPPING CART – REMOVAL AND ABANDONMENT

17.34.010 Removal from premises prohibited.

No person shall remove from the immediate store or parking premises of any food store, market, or other mercantile establishment in the city any shopping cart, wagon, or similar device bearing a notification affixed thereto in a conspicuous place to the effect that such cart, wagon, or device is not to be removed from the owner’s premises, unless such person is the owner or the owner’s employee or agent, or unless such person is in possession of written authorization to so remove such cart, wagon, or device which authorization has been issued by the owner or his authorized agent or employee. 17.34.020 Abandonment prohibited.

No person shall abandon or leave any cart, wagon, or device covered by BGMC 17.34.010 which has been removed from the owner’s premises upon any public street, alley, sidewalk, parkway, or other public place, or upon any private property (except that of the owner of the cart, wagon, or device) not under the exclusive control of such person abandoning or leaving such cart, wagon, or device. 17.34.030 Possession prohibited – Exception.

No person shall have in his possession, for a period longer than 48 hours, any cart, wagon, or device covered by BGMC 17.34.010 which has been removed from the owner’s premises without authorization, or which has been abandoned or left on private property under circumstances as described in BGMC 17.34.020 unless the person having possession has notified the sheriff’s department of the presence and location of such cart, wagon, or device. 17.34.040 Permitting by owner to remain abandoned unlawful.

It is unlawful for the owner of any shopping cart to permit a shopping cart to remain abandoned or unattended on any public street, sidewalk, parkway or alley. (Ord. 320 § 1, 1973; prior code § 4604).

17.34.050 Impoundment of abandoned carts – Procedure.

Any shopping cart which is abandoned or unattended in any street, sidewalk, parkway, or alley shall be impounded by the city clerk. When the name and address of the owner of the shopping cart is ascertainable, the city clerk shall forthwith notify the owner. The owner may recover any shopping cart so impounded within 30 days of notification, upon the payment of an impound fee of $1.00 per shopping cart, together with a storage fee of $1.00 per day for each and every day that said shopping cart has been impounded. When the identity of the owner of any shopping cart which has been impounded is not ascertainable, the city clerk shall hold any impounded shopping cart for a period of 30 days; provided, however, that the owner thereof, upon the furnishing of satisfactory proof, may retrieve any such impounded shopping cart upon the payment of an impound fee of $1.00 per shopping cart, together with a storage fee of $1.00 per day for each and every day that said shopping cart has been impounded.
