Chapter 9.36
CONDUCT IN PUBLIC LIBRARY

9.36.010 Scope.
This chapter governs the conduct of and applies to each person in or about the public library. (Ord. 74-5 N.S. § 1, 1974; prior code § 9-1001).
9.36.020 Unlawful conduct.
It is unlawful for a person in or about the public library to:
A. Smoke or carry a lighted cigar, cigarette, pipe or match or use any flame-producing device within an area posted with a "No Smoking" sign;
B. Make a loud, unnecessary or unusual noise or noise which annoys, disturbs, injures or endangers the health, peace, or safety of others;
C. Engage in riotous, threatening or indecent conduct or abusive, threatening, or profane or indecent language;
D. Maliciously deface, break, or injure any item of property belonging to the city;
E. Explode or cause to be exploded a device which produces a loud or unusual noise or a foul or offensive odor;
F. Eat or drink a food or beverage except when given permission to do so by an employee of the library;
G. Give a name, address or telephone number, other than his own lawful name, address or telephone number, for the purpose of using, participating in a program or receiving library material or equipment. (Ord. 74-5 N.S. § 1, 1974; prior code § 9-1002).
9.36.030 Prohibited noises.
A. For the purpose of the prohibition set forth in BMC 9.36.020(B), the following acts are declared to be loud, unnecessary and disturbing noises in violation of BMC 9.36.020(B):
1. Radios, Phonographs, Etc. The playing, operating or permitting to be played or operated a radio receiving set, musical instrument, phonograph, or other machine or device for the producing or reproducing of sound, except when played, used, or operated by or under the direction of an employee of the library, or representative of Solano County or the city of Benicia;
2. Yelling, Shouting, Etc. Yelling, shouting, whistling, loud talking or singing, except when done under the direction of an employee of the library;
3. Excessive Noise. The creation of any excessive noise adjacent to the library while the library is in use.
